How to file a complaint against a PM in Ohio Cleveland?

Investor · NY · Member since 2019 · 88 posts · 59 votes

Hi all,

I need help filing a complaint against my current PM who's not wiring the funds to my account. His company is located in Cleveland Ohio. I've tried calling some numbers but weren't successful. Most just ask you to leave a voice message but they don't really call you back. Does anyone know where exactly I could file a complaint? What website, emails, phone numbers I could use? Thank you so much!

    Your PM is more than likely a licensed realtor in the area. You could file a written complaint with the RE Board and BBB or send the PM a letter stating that unless there is an immediate response this is what you will do. I do not have phone numbers or websites for you but you can google for those with information you already have.

    I would definitely involve an attorney in this dispute. Let me know if you need an attorney and I can connect you with them

     I would get your attorney involved to rectify the situation, and make sure you are filing a complaint that they cannot come back after you on for something.

    I tried looking him up online. I don’t think he’s a realtor. It just shows he an investor who owns a PM company.

     I don’t mind involving a lawyer if it really what I have to do but I’m just wondering would it cost me a lot?

    I’ll need a new PM soon. I need some credentials and references.  I can’t be bothered with another bad PM

     I don’t have a lawyer yet. Is it the only way to fix this issue I wonder? I’m just not sure how costly and long it’ll take to resolve this kind of problem as it’s the first time it happened to me

     VanBaker company. I’ve always felt uncomfortable having them as my PM in day 1 when I bought my first turnkey property. What’s yours and why are you not pleased with yours? So people can be aware of the bad PMs to avoid

    They are not diligent in creating new leases, i had a billing issue where i was being charged a utility when I shouldn't have, it took 2 months and a bunch of emails before it began to be rectified and currently it's still not. Tenant had a maintenance complaint and it took a month and a bunch of emails for them to send someone out...only to say I need a new roof...meanwhile a 2nd opinion says the roof is perfectly fine. I'm 100% not pleased and am looking to switch companies.

     With a quick look on the state's website it doesn't seem like VanBaker is in any way licensed. I'd suggest working with a licensed firm, we all have special trust accounts registered with the state to ensure clients funds are handled properly.

    Talk to @Carla Kordab she can assist you with more info on working with our team.

     I would suggest filing a complaint with the Ohio Division of Real Estate. Him not being licensed and running a property management company is it itself already an illegal activity. Followed by allegedly taking your money, you could be on to something here that they could help you out with.

    Website to do this is below.

    James is probably providing the same link: https://com.ohio.gov/wps/porta...

    Make sure you have your ducks in a row. Write down specific dates, have a copy of your PM agreement handy and know what it says, etc. If you are clear and concise, they'll take it more seriously and be able to address it correctly.

    Not really. A lot of attorneys are willing to share their tip for the 1st call. So I would reach out to them. Regardless, this is a pressing situation so the earlier you take action, it will be better before the situation worsens

    It looks like R & M invest (Chris Vanuch) sold the building they list on their website for their company address in Feb 2022 to qilin group llc and is in the process of re-aquiring? (foreclosing?) the seriously tax delinquent property operating as Carbon Holdings LLC. The company address, 83 S Maple, is  a C- neighborhood. I drive by it all the time. I thought it was an empty veterinarian office. The images of their 'team members' on the VanBaker website are just stock images. The company was incorporated in Medina Ohio in 2017 by CHRIS VANUCH and MAIREN M. BAKER. Chris Vanuch is a principal in a number of Ohio LLC's including R & M invest, VanBaker Properties, and Carbon Holdings, LLC. It looks to me like Vanuch is primarily operating as Carbon Holdings LLC now. I'd see a lawyer if he stole a bunch, otherwise I'd just get a new manager immediately and move on and make him sue if he wanted to claim that I violated the contract (but you really should get real legal advice which I am not qualified to give, lol)

    If this is professional PM company, it has to have a licensed Ohio Broker- I would contact the broker on record immediately and ask for their direct assistance or that you will be filing a complaint with the Ohio Attorney General and Ohio Board of Realtors

     how many months have you not been paid for ? Do you have an back office portal so you can see what is going on ?  Is this the 1st month? If so maybe you have repairs or a leasing fee? But communication is a must. Owners are ok not getting rent IF they are aware of whats going on ,

    @Jill F.

    I feel like I got a scammer after reading all this info about my PM. He got at least 2 months of rents. I’m trying to find a good PM who can help me with this problem and replace him but I’m not sure if I need a lawyer instead

    I looked him up online and he doesn’t seem to be a realtor. Other wise, I’d do exactly what you’re suggesting

    @Bob Stevens

    2 months of rents. It was supposed to be just August but September came so I’m sure the tenant already deposited the rent on the 1st. There are no maintenane or other fees. The PM was initially just teling me that maybe the delay on the wire was because they switched to ACH but we waited for days and still nothing. I suggested we use a different wiring method but I don’t think he wants to because he just keeps teling me that they’re ‘mtrying to resolve the issue asap’’ I asked for proofs of the attempts to wire the funds to my account. He told me he’s going to talk to his partner for it but really hasn’t provided me anything. He stopped responding to my emails and calls. I sent an email and already warned him that I’ll be filing a complaint. So that’s what I’m trying to figure out now — how to file a complaint, fire him, and get all my money back so I can immediately replace him with another one
