Hello All!
I have a tenant in one of my rentals who signed a two year lease- he has another 15 months on that lease. He informed me that his girlfriend was going to be living with him for some time. I was going to add her to the lease, but it sounds like she will only be staying at the house for the next 7 months because of an internship change.
Does anyone have suggestions for how to go about this? Should I create a separate 7 month lease for her? Or is there a lease addendum I should create to accommodate her time in the rental.
@Dave Bopp Ensure that your addendum addresses whether she is becoming a party to the existing lease (ie granting a leasehold interest in the real estate) or simply becoming a permitted - albeit long term - guest of the Tenant; provided, however, that she likewise complied with the terms of his lease.
Why should you care? In the event of breach, you’d want to confirm that everyone is responsible (ex. everyone on hook for rent, responsible for damage, etc.). Perhaps more importantly, your insurance company may require require written leases with all occupants. In the unlikely event you looked to insurance for some reason, any decent underwriting attorney would undoubtedly attempt to deny coverage, at least as is related to GF.
