I know you can't evict right now, but can you give 30 or 60-day notice to tenant to vacate because you will be doing something else with the property, such as possibly sell? My tenant is on a month to month.
It will vary from state to state. Non-renewal of a rental agreement is treated differently than an eviction and from what I've heard, most states didn't restrict non-renewals.
@Carol Burns you are fine doing a non-renewal and as long as the tenant honors that and leaves-then great. If the tenant does not leave you will have to evict.
@Carol Burns, obviously laws will vary from locale to locale, but generally selling property does not change any lease terms. We had to evict the former owners of a house we purchased out of foreclosure.
I am not sure how the law views evictions versus failure to renew, but in my limited experience getting someone out of a place they legally lived at any time in the past is through eviction.
