The tenants ‘boyfriend’ leaves the property and oddly enough, another male shows up for a short amount of time. This happens regularly, according to the on-site care taker of the property.
There’s either drug dealing, prostitution or a combo of both going on.
She is on a month to month lease.
Is it ethical/legal to kick someone out for suspicion of such activities??

Bruhhhhhh.....Why are you searching for ways to remove an income stream? Evict tenants when they become a problem for you. Is this chick a problem? Doesn't sound like it. This don't make no biz sense playa.

If she's a prostitute (or a drug dealer) and your spy is only seeing two different "clients", then she's not very successful at either. It's also possible she's a piano teacher or a tutor, or counselor. If she's not a problem tenant, don't fix what ain't broken!

It’s still legal to sleep with whoever you want if not encouraged. Admire your old school judgement but it’s something to laugh at not something you should do anything about, or something you could even be sure of.
If it’s true before long she will OD or some dude will fly off the handle.

I vote for leave it be if there are no other issues. If there are other issues then act based on those. If your building is the neighborhood blight then terminate all, upgrade and rent to a better class of people. If you are in a bad neighborhood then you need to grow thicker skin to handle being a landlord in such a neighborhood.
If this is loads of different guys/people then that is different than an individual. Drug trafficking usually will involve multiple, very short, we're talking a minute or two, visits. Prostitution usually involves multiple visit of a little longer nature. Side piece, one person, longer visit. If it tends to be for a pretty set time frame it may be more of a tutoring/teaching type of situation.
I tend to stay out of my tenants' business unless it involves safety of the neighbors or some kind of major crime, so yes, drug dealing would fall into that but most lower level dealers will have more than 1 customer and many high level ones who might only have one visitor are not as likely to have them daily.

My .02 - I agree with some about not being nosy and leaving tenants to do their thing. And growing a thicker skin if you're going to be a slumlord.
On The Other Hand, this is a business and if the OP does not feel comfortable with a certain tenant - for any reason really - he needs to remove them, Especially if it is a month-to-month situation, it's awfully easy to do.
On The Other Other Hand, I would examine my motives and suspicions very carefully before proceeding....

Did she write 'prostitute' on her application? No? Then mind your own business. Seeing two different men enter someone's apartment on the same day is not cause for eviction. If she pays the rent on time and is a good tenant, why make a fuss? If it were a man with two different women entering his apartment, we wouldn't have this thread.
Also, this is a public forum. If you were to kick her out, she's got a ton of evidence it's a fair housing violation right here.

This sounds like the beginning of a porno. Landlord has suspicion. Confronts his tenant. She “works out” a deal.

Side note: At one of my apartment buildings in Cleveland we had this chick running a full on brothel out of her unit. The John's would come in and party all night. It was an 8 unit building and it was a total disaster for all of the other tenants loud music, crack, heroin, property damage mad orgies etc...
Evictions of this kind take forever and the local PD wasn't much help so we had to hire off duty police officers to work 3rd shift security till we got her out of there. They would sit in the hallway in uniform from like 8pm till 5am 7 days a week till she was gone lol.

In fact we just sold a home we had rented since 2008. They were great tenants & we literally NEVER had to visit the property once. The neighbor told us she taught pole dancing in one of the rooms & the guy who bought the home from us found the solid brass pole in the basement & the ceiling header & floor base firmly attached in one of the upper 6 bedrooms. In retrospect pole dancing is NOW considered a 'sport' & may soon be an Olympic contender.

No, it's Not Ethical to kick someone out that violates your religious or cultural norms. it's also not legal in many states maybe it's her College Tudor, Friend, or Relative. Anyway, as long as Rent is being paid we stay out of others' business and mind our own.

this is in our lease regarding prohibited conduct, aka violation of the lease, "criminal conduct, regardless of whether or where arrest or conviction occurs, including but not limited to: manufacturing, delivering, or possessing a controlled substance or drug paraphernalia; engaging in or threatening violence; possessing a weapon prohibited by law; discharging a firearm in the apartment community; or, except when allowed by law, displaying or possessing a gun, knife, or other weapon in the common area, or in a way that may alarm others"
I'm no lawyer but the person who wrote this lease is a lawyer, "regardless of whether or where arrest or conviction occurs" leads me to believe that suspicion of illegal activity is enough. FYI this is direct from the Texas Apartment Accosiaiton lease.

I'm pretty sure in college the 3 girls next door were putting in work, they were 3 of the most attractive girls I have ever seen. They were consistently getting dropped off by different guys in various sports cars. One day my roommate and I helped them move in a tv and in their apartment they had inflatable couches, the tv we were installing, beds, and a tanning bed, that's just about it. They weren't hurting anything and were really nice. As long as everyone is willing participants and they are not being coerced in any way and are willing participants I honestly don't see anything wrong with it, her body, her choice applies here. If they are paying rent and not bothering anyone I would just look away and collect rent for now. You say you are trying to turn the place around, I feel these are the least of your worries. If it truly is a problem property, keep them month to month and focus on your problems. Down the line as you clean the place up this may be something to keep an eye on if you have proof of what you are saying. If it is the same guy this may be a side guy and if that's the case it happens but not evictable.
