Owner Finance Deal

Owner Finance Deal

Hey Community, I am in the process of conducting my first owner financed deal in Texas. I had a couple of questions about structuring the contract so it is beneficial for all parties and was wondering if there is someone with experience in that area. I am a real estate agent and can use TREC promulgated contracts, but our contracts don't really cover owner finance. Thanks in advance!

Use a loan processor like US Loan servicing out of Nevada. You want a pro writing up the contract based on your facts and handling/documenting the payments.

Congrats on getting your first owner-financed deal together. I'd make sure the agreement clearly outlines items like payment terms, balloon dates (if any), insurance, taxes, default provisions, and how title will transfer. It's also worth having a real estate attorney familiar with Texas owner-finance transactions review everything before closing since those deals can have additional legal considerations.

You need a lawyer to draft them the first time. Most of our clients pay once, then supplement hourly on future deals.

Note, DOT, Loan agreement, Personal guaranty, Assignment of rents
