OC owners: working stove and fridge now required on 2026 leases (AB 628)

Quick note for owners with Orange County rentals, since a lot of renewals go out this fall.

The rule: under AB 628, California Civil Code 1941.1 now lists a working stove and refrigerator as habitability requirements for any lease entered into, amended, or extended on or after Jan 1, 2026. A recalled appliance doesn't count as working, and the landlord has 30 days after notice of a recall to repair or replace it. Source: Civil Code 1941.1 on the California Legislative Information site, and the California Apartment Association's summary of AB 628.

What it means for owners: every renewal you sign brings that unit under the rule. A tenant can supply their own fridge only if the lease has the required acknowledgment statement and a 30-day opt-out. A tenant can never supply the stove.

Practical tip: before renewals go out, list the make and model of every stove and fridge you own and check them against CPSC recall listings. Not legal advice.

How are you handling units where the tenant owns the fridge?

I live in Illinois but used to rent in OC so that’s good to know. Thanks!

Danny, glad it was useful, and thanks for the Illinois perspective. Since you used to rent in OC, did you have a working stove and fridge included in your unit? Curious whether Illinois landlords you know handle appliances the same way.
