I'll PM you. Yes going the BBB route is also a good idea.
If you have an active court case the MHIC will NOT proceed with any actions until the court case is finished. The State courts supercede the Commission. If you lose in court the contractor will have a pretty good argument in front of the Commission. You are much better off to start with a MHIC complaint first and if not satisfied with that decision then take them to court. If the contractor does not have a MHIC license they most likely will not do anything. If they do anything it would be a fine and possibly jail if they are a repeat offender.
If the contractor knows the law and cites it your case will be thrown out because it is a commercial activity- meaning that you are not a home owner. If you own more than 4 properties the Commission has no jurisdiction because again you are a commercial enterprise.
If the contractor doesn't know the law it is almost guaranteed that the Commission will rule in your favor. If the contractor contests the Commissions decision you will go in front of an administrative judge who will make a final ruling. The whole process normally takes 12-18 months.
What I’m really looking for is the possibility of them to get jail time for their fraud. The $20,000 that MHIC gives Is no where near the damage that has been caused do not even looking for that financial amount.
