 can I use another agent while under a signed realtor 's/buyer agent agreement. I withdrew my offer on a property(condo) due to conditions with the building.

Sure, but you might end up owing them money. Read your contract.

    @Reuben Lewis, a couple thoughts:

    1. YES! Always!!! However, you may just need to pay BOTH OF THEM! I doubt either could complain.

    2. Your signed buyer agency agreement should make this clear. You might have a "NON-exclusive" agreement where the procuring cause determines whether the buyers agent has earned the commission. That might be the agent who sends you the listing, shows you the house and then hopefully represents you through the same.

    You might also have an "Exclusive" agreement for a set period of time in which case they get paid for any property you move forward to buy during that time.

    3. Why do you want to drop this agent? You only mentioned property conditions which are generally outside the agents control or knowledge.

    4. Why not just talk to this agent? Wouldn't you expect someone you are doing business with to communicate with you proactively and openly?!?

    I give all my clients non exclusive so they can work with whoever they want, works well I would never want anyone forced into anything myself included. Some agents use exclusive though so make sure to contact their managing broker to cancel it in advance, most will let you out if do it before you get a deal contingent with someone else. Some brokers are scummy though and will sue you later on when see you bought an expensive home, so be careful and get it all cancelled in writing if was exclusive agency.
