Hi,
Does anybody know anything about Pinnacle Development Partners, LLC? I saw their ad in Newsweek and the return they promise investors for buying Atlanta foreclosures sounds too good to be true.
Thanks!

Just like my reply to you. I'll reword it so that maybe it'll stay this time. I'll be a kinder, gentler California.... I think we can all guess who is behind Calico, doesn't take too much to figure that one out.

Matter of fact, I did not invest based on the letter because I never saw it -like I said in an earlier post. If you actually read posts, you'd realize that. Ever heard of the saying "Past performance does not guarantee future results"? Keep that in mind - it also applies to people.

Now that we have that out of the way, maybe you can question your own intellegence for wasting your time coming to the defense of somebody that you don't even know (supposedly)...

Calico, If u did not invest pls stay off this thread. you have no right calling anyone greedy. who died and made you the character judge. If u call yourself a christain be mindful of what u say about others. u seem to be starting trouble

    Calico -
I'm going to have to agree with sadddd here. If you are not party to this situation, please do not get involved. This is a very complicated case and calling people who may have lost lots of their money greedy when they were scammed by a ponzi scheme is not productive at all.

    Thank you.

Can someone please post the Address of where we are supposed to send our comments on how it (Gene o' Neal) has affected our lives. I have a lot to say. I was not greedy I just needed some income, so I took some money over the equity of my house. I trusted too much on what others said. Now I don't trust anyone anymore.

Dear Ms Calico - You continue to misqoute. Here is what I wrote (to refresh your memory)...

    ......................................................................
" I haven't heard anything about Kunkle and he should have a big red target on his head for endorsing PDP himself and threatening investors if they contacted investors other than the ones he provided for references (I never saw that letter but others have). How much of investor's money went to pay him???"
    .......................................................................

What part of that says that nobody would have invested without his endorsement? You need to get your story straight. If you are an old lady who just happened to stumble onto this thread and read all 64 pages just for the heck of it, and then interject and defend Kunkle without knowing him, I find that highly unlikely and odd -to say the least. If you are truly a little old lady who knows nothing about this case other than "playing fair"... I suggest you find a new hobby

As far as greed... My wife and I just had quadruplets March 31. This investment was supposed to offset the lost income and help with expenses. What part of that spells greed? I have accepted that my family is worse off for my decision to invest in Pinnacle.

So before you start pointing fingers and spouting off, you might consider all of the people that have been affected by the Pinnacle fiasco. Take your "antics" somewhere else.

NOTICE REGARDING RECEIVER’S MOTION FOR APPROVAL OF INTERIM DISTRIBUTIONS PENDING FINAL RESOLUTION OF ALL DISPUTED CLAIMS

On Friday, July 27, 2007, the Receiver filed a Motion for Approval of Interim Distributions Pending Final Resolution of All Disputed Claims (the "Distribution Motion"). The Distribution Motion requests that the Court grant the Receiver the authority and discretion to make cash distributions from the Receiver Estate to Investors and Creditors of Pinnacle Development Partners, LLC. The Receiver filed his Distribution Motion and seeks to make interim distributions pursuant to the terms of the Receiver's Plan for Claims Administration and Distribution of Proceeds, which was approved by the Court on April 18, 2007.

The Distribution Motion addresses those Claims for which Investors and Creditors did not file a Disputed Claim Form in response to the Receiver’s Claim Determination Notice, as well as those Disputed Claims that the Receiver and the Claimant were able to resolve prior to the filing of the Distribution Motion. Lists of all Investor Approved Claims and Creditor Approved Claims, and the Approved Amount on which distributions will be based, are attached to the Distribution Motion. These Claims represent all Claims filed in this receivership except for twelve Disputed Claims and one late-filed Claim that will be resolved at a later time. If you believe that you filed a properly completed Claim prior to the March 1, 2007 Claims Bar Date, and such Claim is not reflected on the Exhibit B attached to the Distribution Motion, please contact Shuwanda Sloane in the Receiver’s office via email at [email protected] or call at (404) 926-0059

Upon the Court’s approval of the Distribution Motion, the Receiver intends to promptly make the first interim distribution to those Investors and Creditors on the Investor Approved Claims and Creditor Approved Claims lists. The Receiver anticipates that the first interim distribution will likely be approximately 30% of the Approved Amount of each Claim. The Receiver will make additional interim distributions as he liquidates and recovers additional assets of the Receivership Estate.

At this time, the Receiver cannot predict whether or when the Court will approve the Distribution Motion, but anticipates that it will be after mid-August 2007.

Copies of the actual court documents filed were sent to my web administrator yesterday and will be available for your review very shortly. You will also be able to see your approved claim amount on my website. For your privacy, we have redacted your information to display your investor claim number and the first letter of your first name(s) and first three letters of your last name(s) on the line indicating your approved amounts. Please note that the amount shown is your total claim amount. As stated, you should receive approximately 30% of this amount in the distribution. If you do not have access to your claim number or recognize your approved total claim amount, please contact Shuwanda Sloane on the investor hotline with your questions. Thank you for your patience while we completed our reconciliations. We are working as fast as possible to complete your distribution.
    Sincerely,

    S. Gregory Hays, Receiver

    Mr Hays,

It has now been 5 days since this post. When are we going to see these documents on your web site???

california, First I had promised all that I would refrain from comment; however since you're addressing me personally, I feel that YOU have invited a response. I do admit that you did state that you hadn't read the letter; however, you used that letter to rile up the other folks. I pointed out that there is no way that letter can be considered an endorsement; I stand by my statement that if anyone was motivated by that to invest that they were not very smart. I also stand by my statement that it does not look like any of you verified that this Kunkle was really a lawyer or talked to him ...It seemed that California was inciting people to treat someone very unfairly. Finally, I'm not that "old" ...I just aren't all that young.. I was researching the word "ponzi Scheme" and this was a site that came up. So if you'll please refrain from talking about me California, I'll do as I promised and say bye. Calico

Due to the nature of the Pinnacle situation, from time to time, people do jump on board and get involved here. With that said, the member calico has been removed from this site, as he/she failed to listen to our request to refrain from posting on this topic.

Sorry about any trouble they may have caused.

Does anyone plan to attend the sentencing of Mr. O'Neal. I will surely be there.... :superman:
I feel it may make some kind of impact... Although we invested on our own accord, it was still a planned out scam, sham, etc. That makes it illegal.

I wish the court was local because you'd better believe I'd be there. But since I'd have to take 3 days vacation to accomplish that - it's not going to work out. I will definitely be writing a very descriptive letter to the court. I hope they throw the book at him... Hopefully quite a few people can make it, the bigger the showing, the more of an impression it will make on the judge that everyone feels strongly enough about it to show up. If nobody shows, it works in his favor.

When is the court date? My other laptop has all of this information on it but the screen is broke so right now it's useless. If someone could tell me when the court date is I would appreciate it.

    Kevin,

After you posted about checking disbursements, I found that mine was incorrect. Luckily, I had the paperwork to back it up and the receiver was very nice about it. They will have to verify of course but WHEW...that was close!

I just wanted to say, if it weren't for you...I would have lost almost $3000! Thank you! Thank you! Thank you!

All I know is today is August 13th. The day they are supposed to start sending checks. That is great they hope to get a couple more property sales in. Then, include that in the next distribution, but at least get the first one out that was supposed to be here "end of Spring"
as my 80 year old mother is struggling to keep her house at this point. She may be out on the street if this keeps dragging out more and more!
So again trying to have patience here... the question we all have is when are the checks coming and what is the percentage?

I would like to correct an earlier mistake. I would still like to thank Kevin, however, I would also like to apologize to both Gregory and Shuwanda at Hays. Without my mistake, others may make one. I am posting to circumvent that occurence.

When I first checked the claim disbursement on the Hays site, I assumed it was in alpha order, well, it is not. To check your amount, the number from the Claim Determination letter that was sent to us in May has the correct Claim # to check the site with.

Apparently there were several people that would have my initial/abbreviation. Please make sure that you are checking the proper number before you call.

Hays was spectacular about it. Very kind, very helpful. And they have been working very hard. Ms. Sloane told me that Hays has NEVER been able to give a disbursement back this quickly. It may seem like a long time, and it is a long time, however, as someone pointed out earlier, we are so fortunate to have gotten back anything at all, let alone this quickly.

So, let's be a little more patient. Much of the work that they do is time/labor intensive and some of it is waiting for audience with the judge, and closings, etc. and it's not entirely up to them.

Does anybody know what the courts ruled yesterday (8/13) for us?

When will the first distribution be sent?

Mr. Hays, if you read this, please let us know.

    Thanks!
