Hi all, I've been waiting on attornies to consider my project-bid -- on another platform Bigger Pockets recommended (and still no replies!).... so am posting here for additional insight in the meantime.
We have a tenant on a Month to month lease in Ohio.
He is consistently late on rent.
We have a clause that allows for a 30 day notice to tenant to vacate, but have these questions: a. Besides emailing him a 30 day notice, does OH require a reason? We have seen both "yes" and "no, no reason is necessary" by OH legal websites.
b. What kind of verbiage should we consider to ensure he knows he is still responsible for the rent (for the 30 days), the late fees ($30 per day), and will be responsible for any damage done to the home should he do so before leaving.

When drafting your notice, consider including the following elements to ensure everything is clear and understood by the tenant:
**Reminder of Lease Terms**: Begin by referencing the specific clause in your lease agreement that permits you to issue a 30-day notice.
**Clear Communication**: State clearly that this notice is to terminate the month-to-month tenancy and include the exact date by which the tenant must vacate the premises.
**Responsibilities**: Explicitly mention that the tenant is responsible for rent payment for the entire notice period and detail any applicable late fees, such as "$30 per day" for each day late.
**Condition of the Property**: Highlight the expectation that the property must be returned in good condition and note that the tenant will be held liable for any damages incurred during their tenancy.
**Contact Information**: Provide your contact information for any questions or further communication the tenant might need before vacating.
Remember, it's always wise to keep records of all communications and to send the notice using a method that provides proof of delivery, such as certified mail. This can help protect you legally should any disputes arise.
Thank you so much for this! It helps to confirm what we had written is clear and to the point about each item in the lease. Thank you for replying to my question.
