CHW Denying Furnace Replacement Despite Utility Violation – Escalate / Legal Options

Looking for advice from anyone who dealt with CHW (Choice Home Warranty) claim denial for replacement.

My property’s gas utility company issued a violation notice stating the furnace needs replacement. CHW kept delaying by sending/trying to send their vendor without confirming appointments for several days. I also contacted an independent HVAC company, and they reviewed the violation notice and agreed the furnace should be replaced, not repaired.

I shared Gas utility company violation notice and also Independent HVAC opinion with CHW case manager. CHW still hasn’t approved replacement yet.

    Has anyone successfully escalated something similar with CHW? What worked best — executive escalation, BBB complaint, state consumer protection complaint,  small claims court, etc.?

    Would appreciate any practical advice what should I do next.

      I’m sorry someone tricked you in to buying a home warranty.  They’ve been a pretty well known “scam’ for 10+ years on BP.  

      If the whole unit needs replacing and it’s going to be more than $2,000 I’d probably involve a lawyer. Pay them for an hour’s worth of consultation/work and try to collect that from the “warranty” company as well. I’m not sure what your local small claims court limit is and if you can sue them in your location or have to go to theirs. But that’s a backup option.   Good luck and let us know how it turns out.
