My husband & I have been amicably separated since March 2025 and now figuring out our divorce terms. We own 2 rental properties and want continue owning & co-managing them. Is this possible? We're in our late 50/early 60s and these properties are our retirement strategy. For now, neither one of us wants to sell. I was working with a Real Estate Attorney to set up LLC to transfer them into but I'm now concerned about mortgage acceleration when we transfer title since the rates for these properties are 4.1% and 3.25%. Any other ownership or business operating options?
You do not need an LLC to co-own and co-manage your rental properties.
If you decide not to form an LLC, you can keep the properties in your personal names and execute a legally binding Tenancy-in-Common (TIC) Agreement or Post-Divorce Co-Ownership Agreement (often incorporated directly into your Divorce Settlement Agreement / Property Settlement Agreement).
This approach gives you the best of both worlds: 100% protection against mortgage acceleration and a clear business framework for your retirement strategy.
Another option: Instead of deeding the real estate itself into an LLC, you keep the titles in your joint names (or as Tenants in Common). You then create a property management LLC to handle all operations. In most states, after a divorce, joint property automatically converts to Tenants in Common (TIC) unless specified otherwise.
I got these answers from ai. Id reccomend doing more research into these topics and other nuances.
Hey @Sharon Carter'I'd ask your divorce and real estate attorneys about keeping ownership in your individual names with a written co-ownership agreement covering responsibilities, expenses, decisions, and what happens if one of you wants out. Before transferring anything to an LLC, have them confirm the mortgage implications with your servicer. Certain divorce related transfers have protections that don't automatically extend to an LLC.
