The contractors haven't been showing up and they have had 18 infractions (12 electrical , 4 plumbing and 2 framing).

Are these landlord / owners being properly notified and, if necessary, fined or otherwise penalized for their infractions?

And continue to cal the police every time there is a noise infraction, even if you have to do it daily.

These areas are kindy of shady and because the laws are rather new, there has not been much case law yet around lease option infractions in Texas.

They aren't illegal, but they come with numerous very specific and strenuous parameters to keep from being classified as an executory contract (contract for deed) in Texas, and as an executory contract, be liable for some extreme penalties (up to $250 per day liability from the day of sale).Now you can do 1 lease option per year and not have to worry about being liable for more than $100 per infraction, which at the most would be about $1,000.

The cases I read where penalties were levied are all the result of very obvious infractions of fiduciary duty and not technicalities.

The tenant can request a hearing and the violation will be considered at that time and for such minor infractions by minors, a probationary determination can be made.
