I would agree to drop it for the these reasons:-the tenant has already surrendered possession -If they show up in court you might not like the result if an illegal lockout occurred -The likelyhood of collection of a judgment in Texas is very slimI would offer to settle in writing for the  forfeiture of the deposit

Because of that defective notice, the buyer bought the property subject to the mortgage and basically had to surrender it to the lender through a deed in lieu.

Reply in writing that you will be moving AND leave the unit at least broom clean and expect your deposit to be returned on the day of the inspection.The LL should be happy to see you've taken good care of the unit and issue a check upon surrendering the keys.Understand however, if there are damages, the LL can delay the refund and deduct the damages from the deposit.
