you make me want to type words that the forum will bleep out...TO ALL NEWBIE INVESTORS..THIS IS WHY YOU DON'T GIVE PEOPLE THE BENEFIT OF THE DOUBT!! THIS IS WHY YOU DON'T LET DISTRESSED HOMEOWNERS STAY AFTER A CLOSING!! well, they seemed nice, he has kids, he was on disability, etc. look, the guy that bought your house has gone above and beyond to help you, and you still want to screw him financially due to a possible mistake that may or may not have been made in the paperwork of an attorney....do you honestly expect anyone to say, "yes, cheat the system...screw over the investor who has already been too nice to you"???

Let's recap: You are willingly living in mold and feces/filth, are knowingly committing borderline fraud and are trying to screw over a real estate investor who has gone above and beyond to help you.

If any or all of the above is true, then you need help that you are not going to find on a real estate investing forum. So I would recommend you quit wasting time with posts here and instead seek out mental health therapy and a decent lawyer.

I know you are in a tough situation so instead of causing trouble for him, just ask him if you can stay a little longer. But if you agreed to give him the equipment, give it to him. That's my opinion. Also, I would double check the contract if you decide not to give him the equipment because I'm sure the lawyer who wrote the contract should have put those items on there. Good luck!

I didn't read past here, so I apologize if I'm repeating someone.

    This is absolutely wrong.

Those items (Chandeliers, range, built in fridge) do NOT need to be specific spelled out in the contract. Any fixtures ARE sold with the house. If it is attached to the house, it stays. You are stealing if you sell them, and if I were the buyer, and you sold all MY fixtures, I'd make sure the state saved you a place to live for a nice long time.

Keep in mind, any theft over (IN law) $500 is classified as "Grand Larceny" and is a felony. Each state has their own bar, but the highest I saw is $1000.

    I smell troll.

This must be a JOKE! If not mister, you've already lost your home....although you refuse to move.......and if you're truly living with feces, garbage and mold, you will probably soon lose your kids. If I were the buyer, I would report you to child services as well as the health department. Somehow I don't think this will happen cause this story is out of control, and too unbelievable to be true!

If he isn't joking he's the epitome of what is wrong with this country.

Pathetic is the only way to describe this.

    Mike -
It sounds to me like you're here to find out how to scam someone or you're just here to cause problems. You've made that very clear already. The only question is whether to remove this thread and you from the forum or to keep it here as one that people can learn from. Frankly, it is people like you who investors and others need to look out for.

So, what do the members have to say? Do we keep this up as a big fat warning of what they need to look for? Or do we just remove the thread and the OP and go on with our lives?

ahhh, Josh..It's good for entertainment purposes...No seriously for any "newbie" this is EXTREMELY valuable as why you DON'T close if the sellers haven't physically vacated.

    @Travis - PERFECT...:)

I read this post first thing this morning and immediately decided not to respond. I actually believe there is another post from this poster in the latter part of last year. I tried Babiaking it but gave up from frustration.

This, I truly believe, is a late April Fool's joke. I've met many unscrupulous people, but none to this extent!

But, I digress. Are you saying that you built by hand a home previously valued at $3MM all by yourself in 2001? I don’t know about others, but I’m impressed.

Then, became disabled in between 2001 and 2006? Why didn’t you just sell the house before the market started spiraling down? When you stopped making payments, you possibly could have sold the property for more than cost and made a profit for yourself.

I’m not sure about the contract in the State of New York, but in Florida, appliances are deemed to be automatically transferred unless specifically excluded.

What would it take for you to do the right thing? Do you want the buyer to find a house suitable for you and your family, pay the rent and utilities?

What do your teenage able minded kids think of what is going? Just curios.

    BTW, NAL, NLA

Yes I may have been wrong there regarding the appliances, but I was told if it is not attached to the property for example a chandelier then it can be taken. I may be wrong but I hope he understood my intention on what I was saying. Sorry for the misinformation. Thanks.

My vote is to nuke the thread. On the slim chance this is a real scenario I don't see how keeping it around will add any value to BP.

The OP is possibly breaking the law, is certainly immoral, and is doing just about the exact opposite of what anyone with a shred of common sense would do.

Not exactily what I'd want seen on BP.

listen i will tell you the whole truth.. first off i am physically disbled i fell at work.. thats besides the point...

the buyer put an offer on the house and he had the highest offer of 670 i told my realtor to tell the buyer.. to lower the offer by 50 thousand to 620 and just give me 50 grand cash since i have no money that was 2 years ago he was never able to close in time since i had 2 bank mortgages the never agreed on the price simultaneously or once they agrreed but he didnt get a mortgage in time yada yada.. so i guess everytime he had to give an offer for the new contract.. and i guess the banks asked for more money.. he ended up closing on the house for 670 and told me im no longer getting 50 thousand .. because the house acceptable offer went up 50 grand.. obviously this made me mad so thats when i revoke my power of attorny and told him i wont sign if he doesnt give me some money and more time in the house....

so he agreed he gave to 10 thousand, 2 months and he said when u move i will pay ur moving truck and 1 month rent and security for wherever im going.. i told him i would need those 2 months so my kids can finish up school and so i can have time for a garage sale.. he was fine with that because he was still in the process of selling his house anyways...

i just want more money and the most expensive things i own are the apliances and fixture. so i will try again we have a meeting tomorrow or sometime this weekend. hopefully ill push him and get him to let me sell them

    we shall see

Although it is very entertaining, I agree it's so extreme that it's ridiculous.

The key point is not to allow previous owners to remain in YOUR house after you buy - simple, common sense advice.

This, this is just too over the top to be believable. I'm very impressed at how well the BP community responded to the goading but it has little long term value.
    Make it go away.

Besides a lesson on not closing until vacant, the only other value of this thread is the birth of a new forum term:

    Babiaking

Couldn't agree more, Stan. I dunno how he does it.

josh, i think this forum should be saved...at least once or twice a month, somebody posts on BP about a distressed owner wanting to stay in the house after the closing, and they always ask, "what's so bad about that?"....we will all remember this thread and point them to it, and hopefully it'll prevent others from making the same mistakes that this buyer has made...

and yes, 'babiaking' is awesome! that should be added to the BP dictionary!!

I just wanna say that it is so sweet that Josh is active on this site and participates like he does. I post on quite a few other forums, mostly bodybuilding and car audio related, and iv never seen something like this before where the owner of the site is actually really knowledgeable and helpful.

Not that I have much say in the matter but I think you should leave the thread up and maybe make it a sticky.
To the original poster- What happened to you is quite sad but it is obvious you want something which is impossible. You want this new buyer to fix your life! He cannot, noone can except you. I'm sure you want the world to suffer the way that you have but this guy didnt cause your accident and he didn't cause the bank to raise the short sale price. He's just trying to help you move on- So Move on- No curse words.
If the guy had been able to give you 50k then guess what you would be saying my house is worth 3 mill I really deserve 100k. Nothing he could give you would make you happy because you aren't happy with yourself- Get mental help to deal with your situation and help for your children who have had to put up with you living like this- Life goes on.

This is an INVESTOR forum therefore the value to investors as far as future investors is priceless. Noone has given this guy not one idea how to cheat the system.

Note to self- Never do a rent back on short sale insist the buyer moves out before you close on the house and never give them any cash because its FRAUD- see this thread has already helped one investor :D

I've decided after reading through the entire thread that there is a ton of value in this discussion for investors who may potentially find themselves at the other end of the wrath of someone like the OP.

I'm going to keep this up, and hopefully we can make an example of this nonsense.
