Anybody contested against Choice Home Warranty in small court?
We been carrying CHW for last few years and they still denied the claim on AC coil saying that they don't cover rusted parts per their contract. Our argument is what if the part got rusted while we are under warranty. I checked with local court and it seems like I need to find someone in NJ middlesex county to serve citation on my own.
I am wondering if anybody been through this process and if I can get some tips.
The service lists exactly what they will cover and not cover. They cover very little except for normal wear and tear. Certainly, no warranty would cover rusted parts unless you can prove it was a manufacturer's defect. CHW specifically mentions no coverage for rust or corrosion.
