Good afternoon everyone. Me and my family are in a very bad position. We've signed 2 contracts on the home we are in. We've paid our deposit & a couple of months of rent. Then we get a knock on the door & surprisingly we get served with foreclosure papers I'm new on this site. So now we got pa papers mailed to us stating our home is going to sheriff auction on 6/16/2016 @ 10am. In Rogers County. Our home is located in Oologah, Ok. The total pay off is $105,000.00 is there anyone on here that can help us? My wife is disabled & we have a 3yr old also. Please anyone know of anyone who can help we don't want to be homeless!!!!!!
Generally, the last day you can be in the house legally is the confirmation of the sheriff's sale. This is a hearing held about 30 days after the sheriff's sale. Even then, the deputy will give you 24 hours. On top of that you could tender your rent to the purchaser of the property (the bank generally) and that may give you some more time. I understand it is expensive to move but you should not be out any rent as you are probably going to be in the home more than what you have paid. You can always sue your former landlord in small claims for the deposit. You did not give the timeline as to how long you have been there but if the landlord did this within 30 days before the sheriff's sale, they are a pretty sorry individual. If you have been there longer, you should come out ahead rent-wise.
I would get started on looking for a new place or talking to the purchaser at the sheriff's sale (probably the bank) about renting after the foreclosure is completed. If you actually offer them money, you may have legal rights as a renter but you need to speak to an attorney about your specific situation. You should have until mid-july to work something out. Stay on top of the court case by contacting the Court clerk or checking www.oscn.net.
Ok i understand all that. But we dont eant to move. As well ive got contract for labor/materials on this place for we was supposed to be buying after the first yr. But we moved in oct of last yr & the papers show he stopped paying on this place in may. We didn't know of this i know theres a lender out there that can buy for us & we pay back the loan? Its 2.5 acres with 4/2. But auction can get cheaper than whats on the paperwork & we plan on going to the auction ourselves if we cant buy it then we could trying working out something with buyer. For Obama had signed a law in 09' that even though we are in foreclosure our lease is still legal & can remain till our lease is up but we really want to stay but guess its in gods hands at this time.....
Ive done alot of work to this place plus paid outta pocket for materials. Im not leaving with out a fight. I stand behind my word personal & business. Thats why i have 2 contracts on this property other tgan that ill file a lein either way
You need to speak to an attorney to see what you can do. If the bank hasn't been getting paid they will get the property/their money, they are in the 1st postion on the title.
Is there any communication to the landlord or did he shag ***? Thats who you have the problem with, remember it's not the bank's fault the landlord was pocketing/stealing the money that was suppose to be going to the lender.
yes im visiting with 2 lawyers tomorrow i do have friends & their looking to file something to stop the sale. We're hopingthat they will work with us or something? I can file a lien. But yes when we notified the property owner ya all communication stopped but i do have carbon copies of checks payed out to him plus materials we've bought per our contract. But alot of stuff still needs needs repairs. So we hope & pray something goes positive on this!!
