A/C unit old, home warranty claim denied, do we have a case?

Hi All, i hope i am posting this at right place, please advise if this should be posted else where, if so where? My partner and I are small investors in 2 properties in Phoenix, AZ. We have home warranties on both. Our A/C unit on top of the roof is not putting out heat. we got a call from the tenant. Home warranty dispatched a company to us. A/C repair company decided that there was sprayed on the unit (pictures attached). We did not spray this foam. Insurance should have checked all this, before they started coverage correct? Have you run into similar situation? let us know what is your advice?

1) I don’t think you mean insurance company should have caught this, you mean your inspector. Does he have an excuse for missing it? The insurance company doesn’t need to look at anything because they can just deny it later.

2) NEVER ever get home warranties on rentals, they are useless. If they came with the purchase then just cancel them and apply the refund towards the repair. Maybe ask the inspector for a partial refund as well to apply toward repair.

Actually home warranties FOR ANY PROPERTY are useless. I had a unit go out on a house in Phoenix that I lived in. Home warranty kept sending out a repair person and they would repair a small part at least 5 different times in the span of 5 weeks. The guy basically said " your home warranty will NEVER authorize what needs to happen. Replace the whole unit. instead they will replace this capacitor forever because it is much much much cheaper for them." Plan on repairing the unit on your own dime.

Insurance Companies obviously cannot look at every single appliance or unit that they are offering coverage for. They actually do not look at a single one.

Hate to say it, but I think you're screwed....just pay for the repair...

Yeah spray foam on the coil?! The capacitor is in it's box? The power liquid tight isn't even in the connector. That's a hot mess, some inspector should've caught that but FWIW getting all of that foam out of the would be next to impossible. Time for a new unit. Make sure the new 1 is permitted so it's done right. Like the others said home warranties are a scam for both owners and contractors. They telemarket service contractors all the and we just laugh at em. It looks pretty old anyway. Get a new one.

@Jeff And Vishi and the big downside with home warranties your tenant is never going to want to wait for the warranty company to make the repair.

You are going to need to do the repair. It might be better to replace a unit like this but talk to a good HVAC company and see if you can get any concessions from the warranty company. Did you provide your tenants any space heaters.

This is kind of a lesson learned. There are so many companies out there giving home warranty and the warrantee and coverages varies in every policy. All companies who cover the warrantee will try NOT to pay you especially when they charge you less premium. high premium policies usually have better coverage. Buyer be aware. Ask them questions in detail when you take warranty next time
