Tennant causing 5000$ in damages with month to month lease

We bought a duplex yesterday and on the lease for the current tennant they are in a month to month lease . It says we have to give them a 60 day notice of termination of lease and also they have to give us a 60 day notice of leaving.. well long story short they caused over 5,000$ in damages, and have pets which in the lease prior states they have no pets, and we want them out asap. Can I issue a 30 day notice ? Or does it HAVE to be 60 days

What does the lease state?

Ours also requires a 60-day notice, BUT we can give immediate notice for lease violations.

    Well, hopefully they have a full SD and it was transferred to you at closing. Based on this link, it looks like if the agreement states 60 days, that's what it is. Of course, if they fail to pay the first regular rent on the due date to you, then you can start down the Eviction road, which is detailed here.

    By the way, if you did not receive, or if the prior LL did not generate, a move IN condition report with adequate photos, you will have significant difficulty making deductions from the SD.

    Usually lease violations can be used as a early termination tactic, just make sure everything is documented thoroughly for your protection.
