I do due diligence on cabin and small-business deals in East Tennessee. On Sevier County STRs, the question I keep running into isn't "what does it gross?" It's "which permit is this, and does it survive my closing?"

Here's what I've pulled from the county and city documents. I checked them in October 2026, but rules change, so verify with the issuing office.

City or county first. A Pigeon Forge or Sevierville mailing address can sit outside city limits. The county's STR program covers only units outside city limits. Map the parcel on the county GIS, or Sevierville's city-limits map, before you assume anything.

Pigeon Forge R-1. STR in R-1 is limited to owners who were renting short-term on or before Aug 13, 2018 and remitting taxes. Zoning §511.8 says a transfer of ownership "shall also render the Permit void." If you're buying an R-1 cabin, get the city's answer in writing on whether you can get a permit.

Unincorporated Sevier. An annual Fire Marshal permit with an on-site inspection has been required since Jan 1, 2024. Units that applied by June 30, 2024 were grandfathered to the code in effect when they were built. Later applicants, and units that went more than 6 months without a permit, have to meet current fire and life-safety code. For units over 3 stories, over 5,000 sq ft or sleeping 13+, that can mean sprinklers. The county says the permit account transfers on a sale through a change-of-information filing.

The 12-person ceiling. Since January 2016, county COs for overnight rentals have capped occupancy at 12. Per the county, renting to 13 on a 12-person CO is illegal occupancy.

"Grandfathered" ends at closing. Under the state Short-Term Rental Unit Act (T.C.A. § 13-7-603), that protection ends when the property is sold or transferred.

Taxes follow the buyer. Gatlinburg and Pigeon Forge both say a buyer of an existing business is liable for the seller's unpaid gross-receipts and hotel/motel taxes. Neither city will tell you whether those taxes were paid, so ask for 24 months of filings with proof of payment.

Septic. Compare the bedroom count on the septic permit with the listing. Five marketed bedrooms on a three-bedroom permit is a problem, not upside.

One open item: Pigeon Forge had a citywide STR inspection ordinance moving through readings in 2025. I couldn't confirm final adoption or fees in official sources.

For those who've bought in Sevier County recently: did your lender or agent ask for the permit history and the CO, or did that fall on you? And has anyone gotten a written answer from Pigeon Forge on R-1 permits after a sale?

    Thanks, I appreciate it! Where are you invested? Most counties have some version of this, like permits that don't transfer or rules that change at closing, so it's always worth checking with the county before you buy.

    This is such an important conversation, especially here in the Smokies.

    Shelly and I work with STR investors throughout Sevier County, and one of the biggest things we stress with buyers is that revenue is only one piece of the investment.

    A cabin can show great gross revenue and still be the wrong deal if the permits, occupancy, septic, fire/life-safety requirements, zoning, or transferability don’t line up with how the buyer intends to operate it.

    We always say: It’s not just about choosing the right property—it’s also about avoiding the wrong one!

    That’s why we encourage our investors to look beyond the listing and ask the harder questions before getting too far into a deal. What is the legally permitted occupancy? Does the septic support the advertised bedroom count? Are there additional fire-code requirements? Is the property actually within city limits or unincorporated Sevier County? And most importantly, what changes when ownership transfers?

    I really appreciate you putting this together. Regulations continue to evolve, so having knowledgeable local professionals—and verifying the current requirements directly with the appropriate city or county office—is incredibly important.

    This is exactly the kind of due diligence STR buyers in the Smokies need to discuss before closing, not after.

    The whole Sevier County "inspection program" is a farce. I wouldn't even screw with it honestly. Play dumb and ask forgiveness. 

    I'm not recommending dishonestly per se, but these clowns are all over the map. They don't show for inspections, cite weird, non-critical items when they do, promise they'll return for "re-inspections" and they often do not, etc.  It's a farce, that simple.  

    THAT BEING SAID, the septic situation IS legit, and you need to make sure your septic is approved by the Sevier County Healthy Dept for the number of guests you are having.  That pre-dates the "Inspection program" by decades.

    To your lender question, from the financing side it mostly falls on the buyer. Some STR-focused lenders will ask whether nightly rentals are allowed, but I rarely see anyone pull the permit history or the CO. That's a problem on the STR loans that size off projected short-term income (AirDNA-type numbers), because if that Pigeon Forge R-1 permit dies at closing the income the loan was built on goes with it. I'd get the city's written answer back before the appraisal and financing contingencies run out. Great writeup btw.
