Good day BP! Question for all you who are cold texting and/or cold calling. Have you heard or ran into any compliance issues in the state you are operating from and reaching out to potential sellers? Whether they be in the state you are operating from or they are OOS. I was asking Claude (Ai platform) and it brought this to my attention. I look forward to hearing your responses.

Theoretically, ANY contact should be by PERMISSION only. That’s why when for instance you purchase something online the vendor will ASK if they can contact you either by text or email. In other words opt in.
That being said, many people obviously ignore don’t call lists, and text or worse call a “list” of whom they perceive to be “potentially” interested parties.
One would think, intuitively, that “it must work” as people continue to do it. But, I’m not so sure. A friend of mine spend 2 or 3 years selling “texting services” for a subsidiary of a big city daily newspaper. He sold a lot of texting programs, yet he couldn’t identify one where the texting was profitable for the vender. Thru “salesmanship”, half truths, and the reputation of having a big city newspaper behind him, he was often able to obtain one renewal, but again not because that the texting was profitable. Some of these people spend $80,000 and NEVER concluded one sale!
I’m pretty sure we’ll get some posters here who will relate that they’ve been using text or cold calling to great success, and they probably have. But, if so it takes a committed program, over a relatively long period of time, just to see if it works for you.
A better idea (imo) is to spend $2500 for a specialized, concentrated SEO compliant website, and spend the $400 monthly for a top notch SEO consultant. Once that’s established you can consider paid social media marketing as well as SEM. That’s what I do, and I built a business that NETS me and my partner 7 figures yearly each.

@Don Konipol thanks for taking the time to share such valuable information. I greatly appreciate it. If I may ask a follow up question: How would I know I am contacting someone that has opted out? Is this something that the seller chooses to do upon me initially contacting them?

In practice three things keep cold texting and calling clean: A2P 10DLC registration (the carriers' approval for business texting, your CRM provider handles the filing), a "reply STOP to opt out" line that actually removes people, and a DNC scrub before any list goes to the dialer. The Miami team I build for texts at high volume and that setup is what keeps the numbers from getting flagged. For the legal side of TCPA a lawyer beats a forum, but those three are the day-one basics.
