You summarized it well.The safe harbor included in the regs is the only semblance (aside from court cases about whether or not landlords operate a trade or business) of guidance we have to rely on for purposes of determining whether or not landlords qualify for the Section 199A.That said, there are still ways landlords who do not meet the safe harbor tests can qualify, such as operating a trade or business under Section 162.Unfortunately, there is not and, historically, has never been any clarity regarding landlords and TBs.
