Has anyone done business with Four Peaks Capital?

@Ji Yang There are MHP fund operators who have proven track records and have been acquiring and oprating MHPs for many years. Although most such fund operators only deal with accredited investors directly, you may also be able to find some among the crowdfunding sites. Typically, the mobile home funds can achieve very attractive COC, a somewhat recession resistant business model, decent upside as well. Judging by their website, without speaking with them personally, it appears that Four Peaks does not have a long track record in the MHP space. Since they are advertising, I assume that they only deal with accredited or sophisticated investors, as well. If you are thinking of investing with Four Peaks, I recommend that you perform an extensive due diligence check on them. Also check our at least a few of the other MHP syndicators and fund operators to compare. That said, it is always great to be exposed to operators that others on the site may not have been exposed to. Good solid passive cash flow opportunities are not easy to find. Good luck with your investing and please share your experience if you decide to invest with them.

I saw an ad for Wavemark Capital which led me to Mike Ayala on linkedin. That led me to this thread. Seems that the website Fourpeakspartners.com is not working any longer. Plus the reviews above sound very bad. Anybody have more recent info on these guys?

I'm in the Wavemark income fund and am getting paid my distributions

Thank you. It's good to have data points like that.

Mike has been easy to work with for me, I don't know the other guy who it looks like was involved in Four Peaks.

@Jordan Moorhead Very curious how your receiving distributions in Wavemark, and I know 6 other investors who have been in for a year and are not receiving distributions. What’s also interesting is the homes Wavemark was supposed to purchase to my knowledge have not been placed in any park (I know of 3 parks that have had zero infill). What kind of financials and proof are you receiving from the fund?

I'm aggregating a list of investors the Wavemark has defrauded. Please have these investors contact me of they are interested. I've filed a complaint with the SEC and am working with an attorney in TX for possible legal action.

Nothing at all from them in a long time. I didn't get anything all of last year and haven't heard anything in a while either.

More than I would like but nothing that would take me out or cause a lot of pain. It's hard to have money tied up in underperforming syndications when I have good uses for it in our own deals.

thats good we see folks on BP that have put 90% of the retirement funds into these type of deals and its devestating to them when it does not work out..

@Jordan Moorhead I know of many single-asset syndications as well as funds that pay distributions but have negative operational cash flow. Some of them continue to get positive reviews because investors receive their distributions like clock work. Unfortunately, unless you see the underlying financials as well as supporting data for those financials, you do not know whether there actually was cash from operations to pay your distribution or not.

TL:DR Avoid dealing with Mike Ayala at all costs.

Four Peaks Partners is run by Mike Ayala. He also runs the Wavemark Income Fund, a debt fund, which has been in default on an investment I made in the fund for a year and half. They failed to return my capital after a year as the contract stipulated and they stopped making interest payments entirely almost a year ago. I've learned of several other LPs in the same boat through the Kelley Clarke Law firm that is representing several of us and through the Reddit forum linked below.

    https://www.reddit.com/r/investing/comments/1hq19lu/wavemark...

A principle at the firm suspects they are under investigation by the SEC.

And yet they are still soliciting investments in the fund! Stay away.

I'm aggregating a list of investors he's defrauded to share information and coordinate possible action. Please contact me if you're among them.

Do NOT invest in four peaks or any other funds these guys run under any circumstances.

Many years ago I invested in Four Peaks Capital Partners whom Mike is involved with. After not receiving my K1 for one of the funds this year I tried to reach out to them. No response by email, phone number disconnected, and website / investor login disables.

Looking like I will be filing a formal complaint with a lawsuit to follow most likely.

last i heard there was a group of investors talking to a law firm about suing. That was months ago - I lost touch once the conversations moved to whatsapp instead of email. I got busy and didn't follow up with them.

How would I even know? They ghosted all their investors including me. Emails no response. Investor portal deactivated. Phone lines deactivated. It's painfully obvious to everyone involved with them they stole all the money. Who knows what percent was even invested in the first place. Not sure why you are defending them. Luckily it was a very small percent of my net worth so I just wrote it off on my taxes and am moving on with my life.

I am in no way defending them.. crooks are crooks and should go out of business.. I was just commenting on my experience when K 1s were not forth coming from a deal I was in I learned they did not pay the CPA and they would not release them unless paid.

Pretty easy to check public records on the property you invested in to see who the current owner is.. And if you really want to you could pay 250 bucks for a pre lim title report that would tell you vested owner who the lender/lenders are etc..

Its your investment was just trying to help or help others that might read this.. Syndication the last little bit has had tons of failures.. look at Open door Capital turners deal they lost a building and investors lost 15 million .. all of the cash invested in it.. tough times for these type of investments no doubt.

Sure, in a vacuum you could be correct with the K1. But you ignored the other pieces of information in my first post where I said they DEACTIVATED THEIR INVESTOR PORTAL. And are not returning any form of communication. For years now. Doesn't even matter who owns the property at this point. Hell, it could be worth 10x what they bought it for but if they just cut off all their investors you'd need to sue them to try and get a cent back.

ya this is a tough one for investors in syndication that might have say 20 to 50k in the deal.. not enough dough to sue over.. even 100 to 200k is probably a loser trying to sue..
what I have seen work.. is investors get together and then hire a law firm then move to kick the General Partner out and take control with a committee.. Now granted the committee of inexperienced investors rarely can do better but there is a mechanism to take control. Although as you state if its been some years then your right .. right it off move on and be cautious about any other JV  syndication deal going forward.

Looking like I will be filing a formal complaint with a lawsuit to follow most likely.

sometimes you dont get a K 1 because the GP has not paid their accounting bill and accountant holds it hostage until they get paid.. Just sayin

Okay.. and so why might someone remove their investor portal and ghost all their investors? Hmm...

dont know.. just commenting on the K 1 as I have had that happen to me in the past.. Have they lost the property do they still own it ?

And if you really want to you cold pay 250 bucks for a pre lim title report that would tell you vested owner who the lender/lenders are etc..

It sounds like you are attaching Jay for no reason when your anger should be directed at the syndication.

Your original post highlighted not receiving a K-1. It did not mention not receiving distributions / communications, etc

You did not recieve your K-1
You reached out to the sponsor in regards to your K-1 of which there was no response regarding your missing K-1.

Your message does not indicate anything about distributions.
Your message highlights that the only lake of communication is in relation to your K-1.
It does not mention that there was no communication such as quarterly/annual updates, fund performances, etc

You should add seperate sentences to clarify distributions / communications.

'In addition to not receiving my K-1, I have not received a distribution since 2022. Furthermore, there has been no email or update since XXXX.'

      Best of luck to you

Come on man, I said they deactivated their investor portal, deactivated their phone lines, and stopped all communications. Pretty obvious what is going on.

As far as which crime it seems extremely certain they misappropriated investor funds. Also, I am pretty sure intentionally cutting off all communication with your investors (which he definitely did) is considered securities fraud. So that's two crimes.

dont know.. just commenting on the K 1 as I have had that happen to me in the past.. Have they lost the property do they still own it ?

And if you really want to you cold pay 250 bucks for a pre lim title report that would tell you vested owner who the lender/lenders are etc..

It sounds like you are attaching Jay for no reason when your anger should be directed at the syndication.

Your original post highlighted not receiving a K-1. It did not mention not receiving distributions / communications, etc

To be fair, it absolutely did mention those things... Word for word below

"Do NOT invest in four peaks or any other funds these guys run under any circumstances.

Many years ago I invested in Four Peaks Capital Partners whom Mike is involved with. After not receiving my K1 for one of the funds this year I tried to reach out to them. No response by email, phone number disconnected, and website / investor login disables.

Looking like I will be filing a formal complaint with a lawsuit to follow most likely."

This is how people are reading your response(atleast myself, Jay Hinrichs and the people who upvoted my post).

Indiana Attorney General is suing them right now - seems unlikely all the funds were going towards the trailer parks.

Other investors have already started to sue him

I saw even more lawsuits and even prior criminal cases but its not worth my time to keep posting here. I posted here to try and keep other people from investing with him. If anyone finds this thread while researching him, strongly recommend you listen to me. Please save your money.

You have done a good job here BP is very powerful on google search's this thread could very well pop right up there and a potential investor can read this and decide on their own.
Thanks man, and sorry I was snippy at you. I just didn't want anyone to come away from this thread thinking even for a second their funds would be safe with those guys.

NP  thats one thing about electronic communications things get taken out of context pretty easily.. no harm no foul.. I share your frustration I have also been the victim of sponsor going dark and not getting my K 1s  there is a work around for it.  The one accountant that held them hostage though I really needed and that cost me 8k to pay for that losers bill that was do before he would release them to me.

I was hopeful but haven't heard anything since last September 2025.

Can anyone please fill me in if you have more details?

I’m also an investor in four peaks and would like to join any lawsuit. Do you know if a lawyer is representing investors?

Typically your offering documents have a point of contact in order to reach someone and in many instances it is their attorney. You could also try to reach out to their attorney if it’s listed in the documents.

@Reese Wood, to carry forward with Jay's thoughts:  Every investor portal I am familiar with are SaaS companies.  They come with monthly fees to keep it up.

This whole situation is terrible, and I am sorry you are going through it.  But, at the end of the day, it very much comes down to picking between: writing this off, both financially and mentally, or staying invested with more money to hire attorneys, find other LPs, and continue to fight, both financially and mentally.

If you choose the latter, I will say, assuming their wasn't some form of theft and the losses were tied to investments going belly up, you are unlikely to see any financial benefit.  While the actions you describe are in poor taste (to say the least), ghosting investors or having a deal go south, I don't believe rises to any criminal actions.  Again, if they misappropriated funds, that is another story, and one that will likely only be discovered if you sue.

As I already stated, I wrote this off and the 30k I will save in taxes is more than I ever saw from them. There is a whatsapp group of probably 30+ disgruntles investors. I know some are suing and Mike is under criminal investigation right now. Obviously I can't say with 100% certainty but I am 99.99% sure they engaged in criminal actions.

What criminal actions do you think they commited?

I will also add that if you have to mention 'As I already stated', it might suggest that you were not clear in your original message.

They are under investigation by State's Attorney General. Unfortunately, until the case is resolved, those agencies don't release partial info. If you know the names of the parks, you can search for ownership LLC. It is my understanding that they no longer own almost any of the parks that were in the Fund. They did own them all at one point, verified by county records, but when you run them into the ground, the value plummets. In one case, I believe the county transferred ownership to another LLC just so that the park didn't turn into a drug haven.

They always wait until nearly Sept 15 to do the K-1; my guess is they are unorganized internally and don't get the financials over in a timely fashion and then don't pay the CPA.
