Telemarketing laws don't apply to acquisitions, Right?

Question

I hear there's a recent case in Federal Court where an investor was found NOT GUILTY of violating anti spam laws because his text was asking to BUY a property, which isn't sales (which is what marketing is). Anybody familiar with this case... and/or know the details of where more info on it can be found?

The law doesn't say "you have to be selling". The law says "any commercial messages". You must allow the recipient to opt out. Here is a source.

Er all heat lots of things - recommend doing some researching to find the case and get an understanding as that does not seem correct as you could call people to buy their underwear….
