That title caught your eye, didn't it?

I have 4 tenants in this property.

So tenant A & B saying tenant C is smoking pot in the house (I've already given her a warning based on prior rumors). Also, tenant B says tenant D is doing it as well. I have written statements from both tenant A & B. Is that enough to evict the pot smokers?

    This is the funniest thread I've ever read on BP. I went to unclog my tenants toilet about a month ago. When I knocked on the door I heard all this scrambling around. When I went inside it smelled like weed and there were rolling papers on the table. 

    I was like "y'all didn't invite me??"

    I think this Landlord should have expected problems with pot smokers when they saw the names on the lease agreement.  Jeff Spicoli, Tommy Chong and Cheech Marin, should have given a clue.

     Wow, this thread has really taken off while I've been dealing with this - thanks for the laughs, they're definitely needed!

    So here's what went down....

    After reading all the posts yesterday, I was swaying back and forth between "laying down the law" and letting it slide. On the one hand, almost certainly tenant C & D had been breaking the lease by smoking pot. Did it make me mad that they were lying to me? Sure, but there are worse things, and otherwise they were excellent tenants. The problem with letting it slide was that 

    1) What they were doing was illegal 

    2) I knew about it

    3) Tenant A & B knew about it, and tenant B (and her mom) was afraid of the friends C & D were bringing over, insisting I do something about it

    So, I chose an approach that I thought would appease both sides. Yesterday I spoke to tenant C and D individually. Tenant C has been the instigator in all of this, so I spoke to her first. I told her that I heard she was still doing marijuana and other illegal drugs in the house, and that as a result I wouldn't be renewing her lease at the end of October. I said I felt bad since she was otherwise a great tenant, but that the atmosphere at the house along with the illegal activity would create an environment that we didn't want for entire year. Since it's hard to find housing in November, I offered her a grace period from yesterday through the end of Sept. to find other housing. If she can find housing in that time, then she can get out of her contract early and I will refund her deposit. She handled the news well, just saying "yeah, it sucks, but yeah, I know that marijuana is illegal....". I told her that while I don't really care what she does, she definitely can't be doing illegal things on our property, and that I would hate to have the cops be called on her.

    Then I spoke to tenant D, telling why her friend, tenant C was on the way out, and giving tenant D the same early out option for her contract. She said that she'd look around a little, but that she's really busy and actually really likes it at our house, so there's a good chance she'll stay (her contract runs all the way through next August). She also said that she and tenant C "aren't on the same page when it comes to that stuff", which I took for her essentially saying that she's just caught in the middle with this whole marijuana situation. So honestly, at this point I hope she stays...

    And that was that. I thought I had navigated the mess well, and that all was well. I had spoken to the two troubled tenants, and had something good to report to tenant B (the one who reported the whole marijuana situation).....

    I told tenant B what I did, and then a little later I got a call from her mom, saying that "my daughter needs to get out of there", and that "she can't even bring herself to go back there, she's too scared of retaliation". Needless to say, I was baffled. While tenant C & D might have been breaking the lease, in no way, shape or form did I think of them as "dangerous". So here I was, having gone WAY out of my way to help tenant B, and this was the thanks I got. I think she thought I was going to straight out evict tenant C & D, which I might've, except after considering my options, it seemed like an overly pricey, lengthy, and risky move that could end up taking a month anyways. 

    So after trying to reason with the mom, I realized that she wasn't going to budge. And I realized that there's no way I wanted a complainer like tenant B in my house either (she'd shown her true colors). I told her that her daughter could leave, but she'd have to sell the contract. To which she said that she'd talked to her lawyer, and that I was potentially liable since I had heard of the possibility of marijuana a month ago, but didn't mention that to her and her daughter (tenant B) when they were looking at the house. Which also blows my mind! I had already talked to tenant C about marijuana a month before, and she had admitted to nothing. Am I supposed to tell every potential tenant that "hey, just want to let you know someone might be smoking marijuana here, but it's a great place". Really?!?!?! So bogus. But then the mom offered to let me keep the first month's rent if I let her daughter out of her contract and selling duties, which I accepted. Good riddance!

    Wow, so many lessons learned....I'm sort of embarrassed to post all of this, since all of you that said to not get involved are probably saying "I told you so...". But hey, this is my first property, and it can only get better. Right? Haha, looking back at it now, I think the best thing to do would have been to tell tenant D (the complainer) that I sympathized with her (but couldn't do anything since we didn't have any hard evidence), and that if she noticed any illegal activity happening, to call the cops.

    Oh well...guess it's time to start looking for better tenants....

    @Taylor Chiu glad to see you're sorting it out.  

    I think this sort of thing is inevitable when you're renting rooms.  The tenants are going to interact and will NEVER fully get along.  In the future you might think about having a single lease for the entire property.  A group can get together and rent your place.  Then its up to them to get along and that gets you out of the "house mother" role.

    A single lease could work well. Luckily next year I won't have any inherited tenants, so that will be a possibility.

    I think you handled it great !  4 people that may or may not know each other in one space is always going to have a certain amount of drama.  Tenant C could be helpful in in those times

    Interesting development.  

    I was going to suggest that once you resolve this situation for tenant B, there will be another issue that you will have to 'solve' for her soon regarding her inability to carry on a tactful interpersonal relationship.   Some people are just high-maintenance and expect the world to do what they want, when they want.  Sometimes it is justified, most times it is excessive and instigatory.  Since her mom was involved to such an extent, something tells me that tenant B is used to getting her way, and gets pretty bent out of shape when things don't go exactly as she wants.

    Also, there appears to be more (albeit, anecdotal) evidence that these weed-heads were reasonable in the face of gentle confrontation and didn't threaten you and your entire extended family with violence and revenge.  Crazy, I know.

    Yes, the "weed-heads" seem pretty reasonable. It'll still be good to have tenant C out, but I don't think tenant D will be a problem with out C there.

    College kids smoking pot is normal behavior. I would expect your next college renters to potentially do the same.  I would instruct tenants that you have the no smoking policy but you are not the police. If there are serious crimes going on you would expect them to report those crimes to the cops. A college student who has tolerant issues with other students smoking is going to be your problem tenant 9 times out of 10. If the universities pot tested, they would lose half of their student body overnight. The US has not had a president that did not smoke pot in college for over 20 years now.

    Renting rooms in a house will just not work unless the owner of the property lives with them, plain and simple, and basically has to be a month to month, or week to week basis.   I know in this area that some renters are required to get a lease on a property for year, due to housing payments from their employer, however, the homeowner will let them break the lease anytime they desire.  The only other way to do it, is for all the tenants to sign a single lease,  and then I would bet, that if there are 4 tenants, that one of them will skip, but at least this way the others are responsible for the rent payment.    I have seen this tried over and over again.  Renting 4 rooms for $150 a week is good money, that is $600 a week and $2400 every 4 weeks.  Like they say, "it looks good on paper".  If you want to do this, and not be one of the roommates, start a motel. 

    Every landlord knows this: Once a girls mother gets involved in a situation like this, she will win, even if it would go before a judge. Mother's and Father's protect daughters, and either will win in a case like this, i assure you. 

    I lived in a boarding house one time for about 6 months to save money on per diem.  It had at least 20 tenants, and sit up very nicely.  At that time I paid $50 a week he charged by the room, not by the tenant, so a man and wife or whatever could stay together, even with 1 baby.  The owner had his own private area, but every evening every one that was there would get together around the main kitchen table with the owner.  I liked living there and everyone else did too.  You had the gangsters, the pure, college students, psychos, people like me and every other walk of life.   Everyone knew their own boundaries, and you let people know what you wanted to, about yourself.  The only complaint everyone had was parking.  Only 2 cars in the driveway, and if they were full, it was normally a 2 block walk, and it was located in Lewiston, Maine.  Very cold in the winter. Another thing was good, if someone could not pay their rent for the week, he didn't kick them out, he gave them the option to leave or work on the property.  Believe this or not, it wasn't long before that person found a job, and was able to pay the rent.  His rules were somewhat strict, but not to the point you couldn't enjoy yourself.  He had no problems what-so-ever with his tenants.  He only rented rooms, but the house had 3 full kitchens with microwaves.  One kitchen and the basement was a smoking area.  One kitchen was smoke free, the other, well, that was the meeting room I suppose. It also had a very large living room, with 3 televisions, with VCR's and a stereo.  On Friday nights the place would jam!!!  You would also find out who didn't pay the rent on Friday evening, because they would be your drink server.  That was funny alone.  It was one of the most enjoyable places I have ever lived in.  Friday evening at 8:05 PM you had the fire drill that we called it.  Rent was due by 8 PM, and if you were not there, or had not made arrangements, everything in your room was moved to the front porch, by the other tenants.  If you didn't show up before Saturday at noon, your room was rented, and if you hadn't shown up by 8PM on Saturday, to get your stuff he would call the police and fill out a missing person report.    If you did make arrangements  and could not pay the rent until Monday or whatever, you became the maintenance person, the house cleaner, the waiter, etc... and that was the late fee.   This is just another one of my life's stories.

    I'm pretty sure your hands are tied legally unless there is an actual judgement against the tenets for said criminal activity.  If you don't have that, I'd recommend asking them to leave after the lease is up.

    What specifically are you referring to regarding this post?  As much as I ridicule Joe Gore for his comments on here, it is only fair that I defend him when he is right.  I took a walk through downtown Pittsburgh today to grab lunch.  Witnessed multiple drug deals.  More sagging pants than any pair of eyes should be subjected to.  And do you think gangs no longer exist?

    Yes, there are bad people out there in gangs who also haven't yet been briefed on how to use a belt.  However, IMO, the VAST majority of people who indulge in a little casual cannabis usage do not fall under this umbrella.  That's like saying that everyone who drinks Busch Light wears a wife beater and drives a truck with a gun rack in the rear windo...wait...nevermind, bad example.

    In addition, I would be willing to wager that those fine citizens you witnessed this afternoon were not peddling dime bags of grass.
