Oceanpointe (and Morris Invest) Property Management Problems

Hi everyone,

As mentioned before on another post, my husband and I bought a property through Morris Invest back in August 2016. Everything went smoothly, and there were no issues. The only problem that we had was a lack of communication on the part of the Property Management company (Oceanpointe) that we were using based on Clayton's recommendation. The whole thing was set up sort of like a one-stop shop ... Call Clayton, he tells you about a great, completely rehabbed house that he has that he will sell to you for $40k but that he says will appraise for $60k and is renting for $700, and he has his assistant set you up with his network of people (property management and insurance). A few weeks ago, we switched management companies due to the lack of communication from Oceanpointe, and posts on Biggerpockets from other dissatisfied Oceanpointe clients. The new property management company that we went with discovered that the lease agreement provided to us by Oceanpointe might be a complete fraud. The new property management company was provided with a completely different lease agreement by the tenant than what we had been given by Oceanpointe. The "tenant's" hand writing is different, the signatures are completely different (Oceanpointe's lease agreement isn't really even signed by the tenant ... his name is just written), and the rent on the tenant's lease agreement is $350/month, instead of $700. I tried reaching out to Oceanpointe again hoping they would provide proof of payment (copy of checks, or a ledger, etc), but as usual, they have not replied to that request.

In hopes of getting this sorted out, I tried reaching out to Clayton on Jan 30th via email. Below is the email I sent. He usually replies within a day, but so far, no response. I was truly hoping I would get a response, because I don't think Clayton is a bad person, and don't think he purposely sends people toward harm, but I do think he is, perhaps, trying to move too quickly, grow too fast, and, in the process, is guiding, even encouraging his buyers to make bad decisions. For example, he implies that buyers of his houses do not need to worry about performing due diligence. We are learning as we go, and I guess we were susceptible to all of the rah rah and excitement of such exceptional investment opportunities.

At this point, we are waiting to be able to have the new management company do an inspection of the house and an appraisal to possibly off-load it. Fingers crossed that there will not be any additional bad news. I'll add updates here as our ordeal unfolds.

Anyone have similar experience with Oceanpointe's lease agreements ?

Thanks,

~Liliana

you give Mr. Morris far to much leniency  there is no way he is not aware of every aspect of what is going on at least in my opinion..  he is the one making the claims  he needs to back them up.

I suspect based on the investor feedback some major fraud going on here with fake tenants etc. all done to prop up new sales

    @Jay Hinrichs

Exactly!  With talk on rents being paid on vacant units as if they are occupied, who is fronting the funds? It surely isn't the management company that makes $50-80 per month on the property

    Hi all,

Just wanted to share the response I received from Clayton (~17 days after I sent my message):

"Spoke to Doris at the leasing office and this was an inherited tenant transfer from an existing lease by law they had to honor the original price. They were paying the additional market value rent out of their pocket to honor the quoted rent. When that tenant moves out at the end of their lease they would place a new tenant at the market rent rate."

This doesn't make any sense to me.  I am still waiting on the new PM to inspect the house, and I hope it is not in need of major repairs.

Anyone out there thinking of buying through Morris Invest and using Oceanpointe as the management company, don't.  But, if you really want to, make sure you go see the property in person or have someone you trust check it out for you, have an inspection done, and use a different management company.

@Liliana Ruano  ya that's sounds strange since ( at least from what others posted) your buying a home for cash.. giving OP the rehab money then they place a tenant .. so how would there be a hold over tenant in a house your rehabbing a new.. I would worry about the rehab if it was ever done.. and that you bought a home that never got touched and had an old tenant in it.. ??? worth checking I guess.

some strange goings on there at Morris OP.. holly man.. what a cluster

@Jay Hinrichs, I am anxiously waiting on the new management company to do the inspection.  I hope it is not in bad shape.  I hate to say that this is a scam, but its hard not to feel or think it is, and I do hate to think and speak negatively of Clayton and his wife, who is now a big part of the MI company.

@Liliana Ruano Have you ever know the location of the investment properties.  I was in Indianapolis last week, and saw a lot of view better than just looking on the web.

Ken Yeung I would visit a couple of markets to get a couple data points. Two points you can draw a line one point and you are shooting in the dark.

After now continuing to investigate "turnkey" (which they are not by any definition of the term) properties sold via MI using OP as their rehab/pm it seems very clear that this is not a one or two off situation.

I am not sure where the damage stops but @Jay Hinrichs describes the promotional side and obligations correctly above.  At what point we say ponzi I am not sure.  People receive rents on homes that they sent $20k for a rehab and the place is not secure and not livable.  Yet, they have a lease from people like Lisa Lamb and Joe Smith and receive rent every month or two.   Then when the owner starts sniffing around, asking questions, suddenly OP states they had to evict the tenant.  Yet, there are no records of such an eviction.

Rent received from fake tenants= 10% of money sent to OP/MI for rehab.

I have seen it happen now so many times it is safe to say there is something more than not wrong here.  There are solutions for the owners.  Stop your denial NOW!  Get help from somebody local.  Call and email OP so much that they release documents  to you (the most difficult thing about taking over any OP property).  Get ready to spend more money.

Then get on the phone and tell Mr. Morris that enough people are going to put together their stories that his business and professional reputation will be ruined if he continues to run this program any longer.   Then the owners need to consider using BP and this forum to gather together to discuss what action they can collectively take.  Many are here on BP.

Thats my rant.  I just am really feeling sorry for all of the owners out there in Indy, and maybe elsewhere, who have gotten screwed.  It has given the residential investment world a very black eye in Indianapolis.

I have been hesitant to post on here, partially because it is always hard to admit once you have been scammed.  We purchased a duplex from Clayton Morris in Sept. 2016.  It was to be renovated and then managed by Oceanpoint.  In February 2017 they "finished" the renovations and sent us pictures.  Around the same time we received these fees from the county for the place being a mess.  Clayton assured me that this was not a problem, they were taking care of it and it was just a normal thing.  I had someone else send me picture of the place and from different angles the place was far from finished.  Clayton's excuse was that the winter was too cold and certain things couldn't be done through the winter.  He had guaranteed our first year of rent so it was hard to walk away from that.  Mistake!  Fast forward a year, the place is still not finished, the fines are still there and the place is not up to code.   No one from Oceanpoint will ever answer our calls.  The only person that we can ever get on the phone is Clayton who will only give us a mouth full of lies.  "they are working on those fines but the county is really slow."  My husband flew to Indy for a week in January had the inspector out there in 1 day to meet with him, had tit up to code and reinspected a week later!  Meanwhile our renter lived the whole winter without a heater (Oceanpoint told him we were not willing to fix it) and only 1 working outlet in the house.  They rented each side of the duplex for $400 a month yet paid us $525 for each side the whole year.  I am sure this "extra rent" they paid us was nothing after they charged us for renovations they never really had to do.  Meanwhile I am left with a rundown place that they slapped some paint on and has a bunch of fines.  Steer clear of anything to do with Clayton Morris and Oceanpoint!

I can't even begin to describe how many crimes are being committed here. It is so sad that hard working people are getting conned out of there money. Has anyone looked into a class action suite?

@Nikki Stromlund  OK enough is enough.. as we know when things like this happen.. those like you who are not really all that keen on posting on a public forum that you got scammed.. you can imagine all the others who either don't know about this site or others that have the same scenario.

In my mind this all starts at Morris and ends at Oceanpointe..  YOu need to demand a recession  take your pictures.. take screen shots of the representations Morris made on his U tube and file a complaint with the AG.. No one is going to do anything if people do not stick up for themselves..

you can also get a lawyer I suspect a few harshly written letters to Morris ( forget Oceanpointe) I suspect they will be insolvent.. but Morris I suspect has the wherewhithal to make this right.

One person got on BP and did one U tube and posted it here and Morris made a deal with him to take it down and then they would REALLY go renovate like they should of in the first place or give the guy his money back.. in a stunning admission the guy gave MOrris a pass and kept the property.. the reality Is these properties are not as advertised.. IE  C class is easier to rent than A class these are all rehabbed ( which is obvious in your post)  this business just gives our industry such a black eye.. I sure hope you do more than one post.. these people need to be held accountable. YOu paid cash put your money out in good faith you should get at least a product you paid for.. Granted you fell for the sales pitch and probably don't realize the risk involved with this asset class but at least they could have given you what they represented.. the fact that you will have nightmare tenants for years that's another story and another lesson you will learn.. I mean what tenant lives without heat in 10 degree weather..

@Jay Hinrichs  How long has Morris Invest been around? I think it is worth noting that TK companies that have been around for 10 years plus have been around because they do things the right way.

Just a few years, if that.  I don't think he will be around much longer.

here is what I know first hand and what I have seen first hand.. as you know I do a bit of work in Indy and am there a few times a year.

Mr. Morris comes from Fox news and had a very popular pod cast on tech.. so he already had a HUGE following.. some how he got it in his mind to start to market properties.. so he did nothing more than other marketing companies do.. ( and you know of what I speak)

He then hooked up with a ground partner Oceanpointe.. and he went at it.

when his company first came to light on BP myself and a few others comment on HEY this is not even remotely close representation of inner city urban core D and low C class.. even Chris C commented which as you know he rarely does on these types of things.. but it was just so blaringly a case of misrepresentation of  the asset class.

So of course to sell for all cash and have no over sight were do you work?.. well you work the very cheapest area of a MSA.. this as you know  gives also the highest paper returns.. so you have a legion of folks who believe in this guy  from his nationwide pod cast and they literally buy into this sight unseen.  Plus BP put him up on a pod cast which created a ton of business for them as you know there can be an irrational exuberance about anyone who has done a BP pod cast myself included :)

So fast forward to those that bought and it turns out.. the ground partner has gotten a cease and desist from the state and a revocation of his license and you know that's hard to do..

those that wish to post on BP which is probably a small fraction of those that even know this site exist and a small fraction of the people affected and willing to post they got a bum deal..

    the feedback is.

    1. houses where they paid for rehab rehab never done.

    2. being told by morris their house is rented getting rent checks.. upon physical examination of said asset house is not occupied and has not been.. so just fronting rent on non exisitant tenants.. ( again what other local PM's have said when they are contacted by Morris buyers who are feed up.)  all sorts of city liens and fines.. when Oceanpointe won't respond they get to Morris and he just tells them they are working on it :)

So now Morris is off to new markets with I am sure the same model.. buy the cheapest hood house so the return looks great sell the buyer on how great cash flow real estate is and you will retire on these homes. ( he calls it your freedom number)  and sell as many as you can then Duck...

so it would be like someone coming into your town buying 5k houses in Frasier and selling them next day for 40k then the buyer puts up 10 or 15k for rehab and nothing gets done.  At least that's what I have gleaned from the threads there are 500 plus posts.. so you can read them. but that is my understanding.. and I have taken the time to drive by two properties and have spoken to a few of the wholesalers that were feeding inventory into this machine.. I am pretty sure that the feedback on BP is correct..

the lady above went there and has reported back.. what tenant lives in a house for a full year in INdy with NO HEAT. yet they were getting rent.. There was one buyer who put up a U Tube on BP that showed that he had been duped.. Morris right away contacts them makes a deal with them .. and they take it down and do a retraction.. but that's like stealing a candy bar and then bringing it back when your caught ( at least in my mind)

and as you know a duplex that rents for 400 a side or 500 a side is high risk to start with even if everything is perfect all of us in the turn key space have learned that over the years. RIGHT ?  MOrris on his marketing materials touts that doctors and nurses  are living in these homes and that C and D are easier to manage than A because these folks are just thankful for a home and less work.. LOL  Ya Right.. I about fell out of my chair laughing when I read that one..

The oceanpointe folks trials and tribulations are on line at the state of Indiana's AG website takes all of 5 minutes and a few key strokes to pull that info up..

I am shocked the AG has not gotten into this and maybe they are in the middle of it.. pretty high profile stuff going on.. not even sure if Morris himself is an agent.. he is selling real estate on the world wide web.. but I don't know maybe he is.

What really boggles me mind is, Clayton continues to spew this excitement of "cash flow", that they invest in great neighborhoods with tenants who pay their rent, that they are living the dream life and they hope the same for their customers. I honestly don't know how Clayton and his wife say all this with a straight face, when I've personally read over a dozen stories where people were either scammed, lied to, or absolutely didn't get what they were promised.

I am convinced that Morris Invest is only concerned with advancing their own legacy, while if their customers lose tens of thousands of dollars - so be it, no skin off their nose. They keep the best properties for themselves and pass the garbage off to investors. The funny thing is, the more attention (even if negative) they get, this just draws more gullible investors to their website and youtube to fulfill their "dreams of cash flow". Truly sad.

@Andrey Y.  there freedom number is the 5k fee they make on each deal.. end of story..

but unlike the companies that are transparent and do a decent job like.

    Maverick

    Hartman

    Norada

    Hipster

    real wealth network.

    and now roofstock

those folks at least you know up front they are brokers and they have time in the business and they vette their ground partners and try their best to give good value for their clients.. even then we all can't be perfect at the end of the day a tenant can go bonkers and it reflects poorly on everyone.

but this is just out and out incredible.. it really is.. At this point Morris knows exactly what is going on you would have to be blind as a bat not to .. but like you said

and I like this in the movie the informant at the end.  when Smothers is talking to Matt Damons character " its hard to determine when your telling the truth but from my position just seems like Garden variety greed)

there is no doubt if these people with their on line presence would have just done some home work and worried about their client a little more they may have wanted to sell a different asset.. they would have still done well.. why this stuff I don't know.. but they should have stopped a year or more ago.

but I got an email from someone I Jacksonville.. exact same scenario cheapest house in the hood. Now I don't know if they are doing as poorly there at Indy IE people pay for rehab that never gets done.

but there is NO freedom in buying hood houses for the average investors I don't care what anyone says.  not sustainable over time period end of discussion that's my opinion of course.

I think its worth mentioning that some of the ones on the list above are basically Marketers of Local TK companies.

I have friends that invested Turn key in Memphis with @Alex Craig and are very happy.

This this not to say that others are good or bad, but to say that investing directly with the source is a better option in my opinion.  less people clipping the coupon in the middle.

@Mike D'Arrigo   just wanted to clarify @Andrey Y.  is far to bright to fall into the Morris spell and trap.

it was others who this has happened to.. plus those people did not listen to the pod cast I did on your radio show !!!  if they just listened to that episode this would all be Moot  LOL  although its not a laughing matter for the poor people that have had their trust so thoroughly abused and trashed.

Shameful is what it boils down to really.

I am a regular listener of the Morris podcasts and I can see why people invest with them. Their podcasts are excellent and they are very easy to relate to, which builds trust.

The thing people need to understand when making any investment is that you must do due diligence. "Having a good feeling" about somebody speaks more to their interpersonal skills than it does to the investment. Invest only in things you can verify. Also keep in mind, the bigger the promised return, the more due diligence you need to do.

I couldn't say whether Morris is a scammer or just in over his head. He probably has good intentions, but the intent doesn't matter, it is results.

To clarify, I have never invested with Morris. I am taking at face value that other people's experiences are accurate. Before investing in any turnkey, do your own due diligence.

In over his head is an understatement. This guy knows damn well that what he is selling is not what people are getting. If he has good intentions he would stop selling the crap homes and change property managers. He just keeps finding the newbie investors, taking their money and leaving them hanging out to dry with oceanpointe.  The same stories keep resurfacing every couple weeks with a new investor getting scammed.

He is nothing but a scammer!!

He has also been the guest this past week on two popular, reputable real estate podcasts.  The podcast hosts are likely not aware of the problems.  These were large multifamily podcasts and he appears to be pivoting (or supplementing) strategies.

I have not seen a new investor story every couple weeks. Some of the same stories are getting new attention, like this one posted one month ago. She also said the story was previously posted, so it is not even new. Disappointed customers will always be the loudest voice. I am not defending him, but at the same time I am not lighting my torch to lynch the guy either.

My point was that it doesn't matter what his motive is. People need to do due diligence and take responsibility when they don't. Doing a simple Google search returns negative information about Morris Invest. There is plenty of information out there to help new investors make informed decisions.

Even when dealing with a turn key that has a good reputation, you still need to do your own research and verify the sale price and rents are accurate. Never trust a sales person to give you a fair analysis. Isn't that common sense?

in his podcast and youtube videos he mentions teachers, firemen, police officers , nurses, etc are his tenants.  that raised a red flag for me when looking at various listings and then looking at the neighborhoods on google maps.  just sayin'
