Tenant Eviction, Code Enforcement and Court Case Date
Hi All,
I have a tenant who did not pay rent for a few months. This tenant reached code enforcement multiple times for reasons like HVAC not working (3 times hvac contractor went and confirmed hvac working fine and charged me bill). This tenant complained about a water leak and did not allow the sheetrock contractor to put sheetrock drywall after the plumber completed his work. The PM gave an eviction notice and the tenant vacated a few weeks back. I got a letter from the county to attend court. My PM said he will handle the court case. How to make sure my PM handles this court case without any issues to me in future. Does the PM has to attend a court date at the specific time on behalf of me? Court letter came to my home address with my letter on it as the LLC is on my name. Does the PM need to change the court letter name to his name? Since the tenant left after eviction can the PM call the county and cancel this court letter or change to his name to represent me? I have to change to a new PM as the old PM is too busy with thousands of units he is managing and no longer reachable properly. New PM is in touch with the county code enforcement officer and explained all the timely repairs they are performing from time to time. I want to make sure I ask the right questions and set right expectations with the new PM on this. Do I need to call the county myself and explain anything to them? I like the PM to handle as I have to go to work on that court date and it is hard for me to take leave and attend court date. Please advise.
