Possible HOA negligence
My rental property was affected by a leak coming from a unit above it. My HOA was extremely slow to respond and unhelpful, and the leak took two months to repair. Would this be considered negligence? My unit was unlivable during this time and my tenant had to live elsewhere, so I was not earning rent.
Additionally, the HOA me to file an insurance claim due to $20k+ worth of water damage to my unit, which I did, but now I’m unsure if I should have filed it or if the HOA should have. It’s now on my insurance record and could affect my premium. I’m curious if anyone has any advice or legal contacts I can reach out to.
