How do I fire my buyers agent...

Question

Well, I've been working with a buyers agent for close to a month now and he is really, really pissing me off lately. He wont return my phone calls, constantly makes up excuses, lies to me and puts me off when I tell him to meet me for a showing.

I'm under contract with him and I want out. How do I do that?

Give him a notice in writing that you are cancelling your agreement. If you've got a signed contract that you must pay him comission on anything you buy, then you have to get him to sign a release that he agrees that the contract is cancelled.

In future, never sign any agency form that binds you to a buyer's agent for a set length of time, and makes you liable to pay him commission on anything you buy, whether he is involved or not.

When you sign a buyer's agent contract is should do no more than state that the agent will represent you and that you will pay him the commission on any house that he finds for you.

You can even sign the conrtract one house at a time.

If an agent wants to insist upon a more binding contract, just tell him no. He won't allow you to walk away and lose the possibilty of making a sale; he'll agree to the lesser contract.

Most buyer's agency agreements, like listing agreements, should allow for you to back out at any time.  One caveat is that typically the agent would be owed a commission if you were to purchase a home that he/she brought to your attention. Typically, if it's a different home he/she never showed you then they have no right to the commission.

Ultimately, your agreement should specify how to terminate the agreement and under what parameters this particular agent would be due a commission.
