Question about Real Estate Brokerage Law in CO

Hello!

I have a question for someone who is familiar with real estate brokerage law in CO.

I'm starting a business that offers a service to owners of vacation rental properties where we will help manage their advertising listings, inquiries from travelers, and reservations. This service is offered as an on-going service or a short term service while the property owner is on vacation.

We also provide admin services (listing maintenance, listing creation, social marketing, etc) on a "per hour" basis. (I am not a full-service property manager…this is a marketing & booking service.)

I posted a survey on a forum for owners of vacation rental properties and someone replied to my post with this:

"I doubt you have looked into the legality of your proposed endeavor. You are skating on very thin ice, if not already breaking thru, on the real estate brokerage laws of a least of three of the state I'm licensed with. I'd look carefully before you leap!"

I am not a licensed real estate agent, just someone who has over 11 years of experience in the vacation rental industry & am offering my expertise & service to others for a fee.

Can anyone help me understand what the concern would be for this type of service in relation to real estate brokerage laws? I'd appreciate any feedback!

@Valerie Rogers I think the reply you got on the other forum was probably referring to the fact that in Colorado you have to be licensed to be a property manager. Although you state you are not a property manager, you are performing some very property manager-ish functions. Your intent is probably irrelevant if you are actually performing functions considered to be property management functions by CREC. You need to get a licensed Colorado attorney to take a look at exactly what you will be doing and see if you will need a license. You may also be able to call CREC and get some answers. Good luck.
