Buyer agent mistake

Other than being sued by buyer, what happens if an agent forgets to include in an offer that the buyer is selling a home and the proceeds will be used to pay for purchase. However the buyer who is selling another property fails to close and the seller of the property they want to buy decides to keep the earnest money because they didn't close 

what liability does the buyer agent gave in this transaction?
