closing tomorrow, house filty. Unresponsive sales agent.options?

Question

I am scheduled to close tomorrow. my contract says "broom clean condition", which i think is standard language in most PA's.

well, i went there yesterday and the house is still a mess, multiple refrigirators, ovens, wheel chairs, porn tapes, cabinets, water heaters, dolls, tables, you name it, it's there.

my agent left multiple messages with the sales agent (a huge knob!) and nothing. he does not call back.

what options do i have?

Get a bunch of high school kids to clean it up and give them the porn tapes for payment...

The title company can issue you a check for the balance, once they change the closing statement to account for the credit.

Sounds like you may want the deal more than they want to clean prior to sell.  Perhaps the seller knows that. Factor in removal costs and close the deal.

99.99% of the population wont want that porn.... it's on 8mm roll and the pictures on the box (from the 60/70's) show gerbils and tubes.

Åre you a cash buyer? If so, get a credit at closing.

If you are not a cash buyer then because of TRID you may not be able to get a closing credit. Have your attorney draft a document stating they agree to empty the property by such and such a date and hold money in escrow until it is complete.

I also closing on a house in a few weeks. Is it normally expected for them to have the house clean when they leave or does it all depend on the contract. If you dont state that in the contract then they can leave it however they please?

If you have not had the cashier's check made out yet, do it for $38k and bring $2k cash (or some amount you feel is reasonable for cleaning) That way if the HUD is changed you hold the cash

wayne,  so if my check is for 40k and we let's say agree on 2k reduction,  do I have to go to the bank and exchange that cashier's check for one that's 38k?
