Owner Financed Land - Can you build?

So I've seen a lot of varying answers and thought I'd pose this to the forum.

If you obtain owner financing on a land purchase do you have the right to build?  In my case I'll be purchasing property from the family trust and know they are willing to allow me to build on the property.  My question is are their additional hurdles to overcome in order to go about this process?  Would purchasing the land at the seller's basis and do a separate contract for the remaining asking price make sense to give a clean title interest?  

Just curious.
