2 adversarial partners hold mortgage

I hold a mortgage with my partner, but my partner collects the mortgage.  I asked lessee to pay me half and partner half, but they won't do it. My partner is keeping all the money right now. Do I have any recourse without involving lawsuit?  Any self help ideas?
