Selling Duplex - Tenant vacated damaged unit
I’m closing on the sale of my duplex early-mid Sept (St Paul, MN) Upper unit vacating end of August (I did not renew their lease and gave them 90 days notice). The upper unit will be owner-occupied once sale is complete. They caused $1700 damage/ more than their deposit. Do I get to keep their deposit since tenant will not get any of it back or do I have to give it to the new owner at close of escrow?
