Creative Closing Strategies for a Wholesale Deal

Hi BiggerPockets,

We currently have a wholesale deal in MA we're trying to close. Unfortunately the original P&S doesn't have "and/or assigns", which I believe means it's not assignable in our state (since it's not explicitly stated).

We reached out to sellers to add the clause, but now they are requesting ridiculous concessions for it. Besides a double closing (too expensive on a 2m dollar deal), is there any creative way to pull off a wholesale without assigning the agreement?

I’ve looked into using trusts (having us resign and the end buyer take over) but end buyer’s lender isn’t going to approve a deal where we’re still listed as the buyers (our trust).

Any help would be appreciated.

Best,

Andrew
