Auction Property Seller not complying

I'm in the process of purchasing a property at Texas. Got the property on auction and purchase contract is ambigue regarding liens. The property has a UCC solar lien, and the seller, Idaho Housing Administration, needs to provide authorization to negotiate the payoff. The closing date is in two days, on December 31st, and I've been waiting for this document for three weeks. Also, would it be advisable to consider legal action, and if so, should it be before or after closing, in case I end up having to pay the full payoff amount without negotiation? Thank you!
