REO closing delay by the seller

I was in the escrow for a REO property. After the money was wired to escrow and ready to close, a lawsuit was filed by the previous owner against the bank the next day. I was told that it will take another 30 days for the bank to settle. What should I do? Should I file extension for 30 days as a buyer? However, it is the delay caused by the seller. Can I request a per diem from the bank? How about the reimbursement for the delay it caused?
