Maybe both....in Texas the law is the same across all counties.  It is a state statute, but how it gets applied varies by county.  Sometimes the sheriff does the sale, sometimes an deputy, sometimes the constable, sometimes an attorney or attorney assistant for example.  There are also all kind of other variances.  Some want cash, some don't want cash.  Some want cashier's checks, occasionally one will take a personal check.  Some you pay the Sheriff, some the tax office, some the appraisal district, some the county clerk....and on and on.
