Convert Attic to legal apartment

Hello all, Im a new investor in the Hudson Valley.

I purchased a duplex with a finished attic that has a bedroom, bathroom and roughed in plumbing for a kitchen. 

Pre closing the City building inspector declared it unhabitable space. My question is, is anyone familiar with how I can make it a legal apartment to where I can request a CO change from a 2->3 family. This would significantly add to the value of the property and would Increase my rental income a ton.

Another question is, would this be worth it? I know that It would most likely take a lot of time and money so is it worth the effort?

    A few things to consider here.

    Is the property zoned for a three unit building? Check the zoning district and what is allowed. If the zoning only allows sfh and two unit buildings and there are no other 3 unit buildings in the area within the same zoning district, that will be difficult to seek a variance or Special Use. The zoning dictates what is allowed.

    Many zoning districts restrict the number of units based on lot size. For example 3000 square ft per unit. This would require a minimum of a 9000 square foot lot.

    Parking is another matter. Is there enough parking available on site. If street parking is allowed that might help.

    I spent my career evaluating zoning and building code restrictions.

    Check with the zoning department or it might be under a Community Development umbrella.
