Solo 401K - LLC Manager Managed

Philip Meza
Posted

Investing in Real Estate (Rental) - Forming a Serie LLC

Series LLC is formed with the Solo 401k Trust as sole member,
Any advantage/disadvantages with each selection?  Manager Managed or Member Managed.

If Member Managed, then only the Agent and Solo 401 Trust names will be listed in the LLC formation doc. Since the trustee is the owner of the 401k, then all documents will be signed by the owner but his/her name does not appear anywhere other than the Operating Agreement (Anonymity).

If Manager Managed, then the 401k owner's name will be listed in the LLC formation document as manager. Defeating anonymity.

Appreciate your comments in advance,

Phil M
