Quick Question
If a Homeowner Died 5yrs Ago and They Didn't Leave a Will, Don't Have Any Children....
She have a Ex-Husband That's Living but They Divorced in the 70's....
And Her Mail Is Going To A Cousins House....
Is There Anything That Can Be Done With This Situation????

If woman is dead and has no husband at time she acquired property and then became deceased and she has not children, then the property is inherited by her mother and father.
If they are deceased then the property is owned equally by all of her brothers and sisters.
There will be required heirship affidavits which I can do in order to convey.

Cousin has no interest in the property, unless mother and father are dead and there are no brothers or sisters.  Property would pass to brothers and sisters of mother and father, which would be aunts and uncles.  If any of them are deceased that share would pass to their children, which would give cousin a share.

You will need to find out this information, but on the face cousin has no interest or right to sell the property.

A client of ours died a few years ago and did the same thing, no will. The state took it, took half of what the home was worth after selling it and let the family members fight for the leftovers, we don't know which family member got it or how the state decided WHO got it. This happened pretty fast though I am surprised the state hasn't done anything in 5 years with the house you describe.

The person / family member we met at the house said the owner also had 2 mil in the bank and the state took half of that too. They were asking if she maybe in passing told my husband who she wanted to leave everything too. They were desparate. I would have said "Yeah, she wanted everything to go to her faithful poolman" ;) Sad case. Good luck with everything.
