Terminating a Texas Listing agreement?

I've got a property that is listed with a traditional full service broker. I'd like to terminate the listing with the broker and relist with a flat fee broker. If I am reading this contract correctly, it doesn't say I can terminate the agreement, however it does state there is a 60 protection period.

Is terminating the agreement considered a breech and the broker is compensated?

You can terminate a listing in writing, I suggest you do somy registered mail, return receipt requested, with termination upon receipt.

The 60 day period does protect the broker as they have listed it and probably advertised. If that broker was the procuring cause of any sale within that time periodor after the listing expires, they can demand a commission (usually rare for several reasons, but they can).

You flat fee broker can call that listing broker and make acceptable arrangements for any commission, usually, but some full service brokers tend not to be very accomodating with flat fee types, IMO.

You should ask the flat fee broker and see what they recommend, so long as you approach the new broker about the listing, that would be fine. Good luck
