Appraisal Question Regarding a HELOC And A Second Kitchen

I am in the process of getting a HELOC on my home and an appraiser is giving me a hard time about the kitchen located in the accessory apartment. I have all of the building permits and plans (I am not the original owner of the house) but he claims there is no mention of a kitchen. I did a bit of digging and found the second kitchen is listed in the city property records. Does this make it "legal"?

Also, wouldn't the house not have passed the fire inspection and first appraisal?

Oh, and the house is in MA.
