Investing into a trust Deed for a jointly owned property

Let’s assume you want to invest into a Note secured by a 1st trust deed on a property.

The current title is jointly owned by husband and wife, but the borrower on the Note is only husband.

Are there any legal dangers if it comes to foreclosure?
