Encroachment Issue

Greeting;

Single family home for sale. Owner's relative lived next door and conceded to letting him build his fence 4 feet wide (90ft deep) onto their (her-his daughter's)property line for RV maneuvering. Daughter sold house (the property that got encroached upon). Current owners have not asked for this swath back yet or fence to be removed.

Q? Say I purchase house that's for sale- can the next door neighbor file legal action to get back their 4ft by90 strip of property?

Q2 If I purchase house can I get the next door neighbor to legally relinquish rights to this strip of property. (i'm guessing hell no)
