How can I properly evict my Tenent (NJ) ?

Hello BiggerPockets community. I need some legal advice on how to property evict my Tenent and if I even have the right to do it . I am located in Elizabeth NJ I recently purchased a multi family with a section 8 Tenent in the second floor. As I do with all my properties i renovate the unit and rent out for what the market is renting at . Tenent is currently on a 6 month renewal that ends June 30th . Tenent has been paying $1000 for about 10 years . Current market is renting at $1500. It’s a big difference. If it wasn’t I would not even bother and keep them . Can anyone advise of what I should legally? Thanks in advance.

Hello Pablo,

The legal side of this is all based on the current agreement and what your options are based on agreed upon terms.  My recommendation is to send a renewal offer for the new rent amount and let them decide is they want to accept it or not, at which time the tenants should give notice to vacate.  If they don't give notice within the terms of the lease and don't agree to the new amount, than you will have to give notice to vacate.  if they don't vacate at the end of the lease then you will have to start to eviction process.  Good luck
