Recourse for Deed Restrictions Not Disclosed

Hi! I recently closed on a single family in a residential community with an optional HOA (Annual fee is optional to pay). After moving in the HOA informed us of covenants on the property attached to the Deed. The sellers did not disclose these restrictions and the Title Company did not uncover them. When I reached out to the Title Company to confirm these covenants after we closed they did confirm they are applicable and did not originally locate them because an HOA was not listed on the contract since it's optional.

Do I have any recourse? Is it worth the hassle? Who's at fault?

Any guidance is greatly appreciated!
