Eviction Question
I know it probably varies state-to-state. Here's the question anyway. May a landlord continue to evict a tenant who is grossly late on rent (as of now, 13 days) after starting the eviction proceedings if the tenant tries to pay rent? What I mean is, I just want this guy out as I know I'm going to walk into problems with him down the road. It's the very first month of his lease and he's late. I want to evict him, but I believe he will try and pay in a few days. I would like to reject his rent payment and just get possession of the property.

It depends on what your lease, and state law, say. A Pay or Quit gets served on the 4th if my tenant is late; they can pay in full, with late fees, up until the court date. The longer you wait, the longer it will take to evict and the more money you will lose.
Why have you waited 13 days and why do you think he will eventually pay? For a first month tenant to be late halfway through the month does not bode well for either of you.
