Is renter entitled to security deposit?

Stacey H.
Posted

Our renter gave their 30-day notice on July 31 but did not pay the August/last month's rent. They are leaving the house on August 6. Are they entitled to any of their security deposit?

Aloha,

You need to confirm with your local LL/Tenant laws, but typically, after deducting allowable and documented repairs and cleaning charges, you can apply remaining to unpaid rent.

However, if they are leaving on the sixth, depending on local law, they likely need to have August rent prorated first, for six days. They would then, depending on the terms of the Rental Agreement, likely owe a late fee on the six days, in addition to paying for the remainder of the 30 day period.
